Police say 20 year old Scott Burch and a co-worker were on a business trip from the Sacramento area. via ABC30.com

Well I know I would have beat him also...but I hope I would have stopped before I killed the homosexual.(is that better TOPIX??) I guess he hit him a little too many times. Is it justifiable? We will see what the court says. |

Man - ive known Scott for 8 years - he's one of my coolest homies. i know he'd only go that far if he had too. Plus the jenkins fool was already in horrible health from being in prison most of his life. he didnt mean to kill him, but it turned out that way. i woulda done the same thing man

Your butt pirate buddy, Burch, had to come up with something quick when the police showed up, so he made up the whole story to cover his ass. No pun intended. Truth is, he had a melt down when Lee rejected his homo advances. |

Oh you worked in the system all right - u worked in a LOT of people's systems. JENKINS was a convicted FELON fooL! How can u stand behind his credibility when he has none!? How would u like it to be put in that situation with a crazy 54 yr old man straight outta prison and have to resort to killing the guy to protect yourself and THEN go to prison for over 6 months for it and having an involuntary manslaughter verdict on ur record ur whole and the WHOLE TIME feeling horrible for a family that ignorantly cant bring themselves to see that truth that their family member was NOT the victim here!! Open your F*ckin EYES!! this isnt like playing Grand Theft Auto! this is real LIFE, b*tch!! Scotts one of my best friends for over 9 years - u prolly only knew Jenkins from a few times smoking weed & drainkin now and again - maybe got into a lil mischief yourself (im right arent i?) so cut the bullsh*t and stop playing the victim game and take some muthaf*ckin resonsiblity for CHRISTS SAKE!! The jury felt that it was a lawful act of self-defense until the final time he struck Jenkins. This was after Jenkins was no longer moving and hotel employees arrived and told Scott to back away. He did, but then delivered a final strike. The way the law was written, the jury had to rule involuntary manslaughter. It is unfortunate that the final hit was made and also that Scott will have a record for a long time. Hopefully his sentence will be the shortest possible and he will be able to get on with his life. Kevin, when you see Scott, please tell him to use this horrible experience as a life lesson and move foward in a positive manner.

Thank you Juror for your explanation and i also thank you for the declination of the more serious charges and your understanding. The only thing i will have to add that i disagree with is that when you're in the moment of something life threatening, you dont know whats going on or what you're doing. I'm sure there has been moments in your life where you've gone too far in your words or actions - for instance in a relatable way you're telling a joke and ur getting a lot of laughter so you keep goin with it until you go too far and thats when theres silence and you apologize later. i know in this case its definitely no joke, but you could just a lot of situations in life how you could go overboard with ur words or actions that get you in trouble. But once again, thank you for understanding and outcome. I know its just based on my words and you dont know me, but you have to believe me, coming from a straight-edge no criminal record church going guy - Scott wouldn't have dont what he did if he didnt have to and hes a good person. He's very smart, very caring, very humble - just an overall good person such as yourself. You wont be disappointed. ill talk to him when he gets home and let him know your advice. Thank you again. I'm glad this is almost overwith - hopefully ill be pickin him up at the sentencing on tuesday. |

1 However, I also believe that he did not intend to kill this man, he just acted in the heat of rage. Therefore, involuntary manslaughter is the right conviction. Because he used excessive force, he must be punished some kind of way. It's just unfortunate. I know he was provoked, but he cannot use deadly force once the threat was eliminated. If he would have hit him once and the man died from a head injury, then he would not be guilty at all. But when you beat someone after they are unconcious, you unfortunately become negligent. |

Well, Fred, you're right. Because of course we've all been in this kind of prediciment before. I remember the last time a guy tried to rape me, mighta been yesterday, and i only beat him to be unconscious and then stopped there - just like the last time a week ago - cuz this shit happens everyday to everybody. DUDE!! No one knows how they would react in a situation like this! There are people that say "Whats wrong with these people opposing the war in Iraq - my sons over there and im in total support" Then the son dies and the next day theyre out there with protestors saying "Bush killed my son!". No one knows how they would react in any crazy and unusual situation. Scott told me he was scared out of his mind and blacked out and seriously couldnt remember even beating him after Jenkins was unconscious cuz he was so scared for his life. One could easily say, "If I was put in Scott's position, I woulda stopped after the guy was unconscious". I bet you my life Scott would say the same thing if this didnt happen to him. And plus - whats more? Jenkins was a criminal - he was soakin up the fed's money from being in jail his whole life, he was 54 - never goin to amount to anything by this point but more trouble for everyone. Its not like we're talkin about Scott killing an INNOCENT person here. All those making these excuses - do you REALLY believe you have any idea what ur talkin about? The nicest sweetest person in the world coulda done exactly what Scott did. You CANT know cuz none of us have been in Scotts life threatening situation!!! |
