There is no kindness, or compassion for criminals. These people are breaking laws as soon as they jump that border. Do you not respect the law? How many laws do you break, and then make an excuse for doing it? There is nothing christian about shielding the criminal element.

The Old Testament is a record of the relationship between the jews and their god.(Have you read the Code of Hammurabi? It's another set of laws for another group of people.)
