"...allow each side the time to gather the facts"?

How much time do you need to realize married couples in NJ get federal benefits, while civil union couples don't get the same federal benefits?

Wow, that took me all of 5 seconds to type.

What the state is REALLY saying is "please let us stall and delay the inevitable just a few months more".....

And yet you wondered why I predicted a summary judgment being issued in this case. Any Judge worth his or her paycheck is going to realize that no matter how much time and effort is put into a trial to try the questions out, the defense of the civil union scheme is never going to be any better than it isn't right now. Their horse is dead. Put them out of their misery now and put them in line for an appeal.

The case went in asking two basic questions, whether civil unions were a constitutionally acceptable alternative to marriage that the Lewis decision allowed and even if they were, were they constitutionally acceptable under the US Constitution? Since the answer to the second question is now obviously no, the answer to the first is kind of irrelevant at this point.
