Just like marriage equality already existed in the 50s -- Blacks could marry the same-race opposite-gender partner of their choice just like Whites could.

If you think about it: The driving logic behind Loving is that couples have a right to make their own choice to marry. It is more about that choice than it is about race.

One could hardly argue that anyone is born to love only someone of a different race. Had the Lovings ended their relationship--as the state of Virginia wanted--they undoubtedly could have each found suitable partners elsewhere. Neither was incapable of loving a person from the same race.

So the Loving decision was really not about immutable characteristics as the "sexuality is a choice but race isn't" crowd likes to pretend. It is about personal choice. Race enters only because of the long-held prejudices that society tried to impose upon the Lovings, who obviously did not share those prejudices.

If we want to frame the debate in terms of immutable characteristics, gays have a stronger claim to protection than do interracial couples. After all, individuals in an interracial couple are capable of loving someone else of the same race. Gay and lesbian couples are not necessarily capable of forming that same life-long commitment with someone of the opposite sex.(Just ask Larry Craig.)

As a society, we respect the choices of all sorts who marry--those who marry on a lark, forced by a shot-gun, for the third, fourth, or even fifth time, for mutual convenience, etc. But for some reason, we feel compelled to deny that choice to people who fall in love and commit themselves to someone of the same sex.

If we were all bisexual, perhaps a case could be made. But that case would negate the logic behind the Loving decision as well.

We have got to start recognizing Loving for what it is: A case about personal choice, not about race.
