But what gives the Federal Government the right to be concerned at all at what the definition of marriage is? Sort of going in a circle. You're saying — you're saying, we can create this special category — men and women — because the States have an interest in traditional marriage that they're trying to protect. How do you get the Federal Government to have the right to create categories of that type based on an interest that's not there, but based on an interest that belongs to the States

So we're looking at DOMA being overturned and federal benefits being extended to any married same-sex couples.

Prop 8 overturned and California back in the marriage equality column.

That leave us another 10 states where marriage equality can realistically be passed by the end of the decade.

20 states by 2020; then it's back to the SCOTUS for the rest.

In reality then, you aren't working toward what is right, fair or legal. You are just manipulating till you can get a liberal court.

I agree.......

The issue is not defining marriage, but rather eliminating legislation which prohibits two consenting adults from marrying in pursue of happiness for their lives.

Opposing marriage between two individuals who decide to commit to each other solely because some in society don't like their preferences is State Sanctioned Discrimination and omitting those citizens from beneath the umbrella protections offered each citizen under the US Constitution.

Once the States Sanctions Discrimination, the slide down the slippery slop toward Fascism has begun, opposition against equal access and protection under the law of the Constitution begins in earnest the erosion of Free Democracy in America.

What's "right, fair, & legal" is equal treatment for all. If the current republican-dominated SCOTUS won't uphold that, then YES we'll wait till we flip the court.

Justice Sotomayor:

Outside of the marriage context, can you think of any other rational basis, reason, for a state using sexual orientation as a factor in denying homosexuals benefits or imposing burdens on them? Is there any other rational decision-making that the government could make? Denying them a job, not granting them benefits of some sort, any other decision?
