If the Court takes the case and the State loses the case, which seems likely, the Court not the State decides how wide the decision applies. These losers (Republicans) need to get a clue, they are on the losing side of history.

I agree. The tide turned in our favor a long time ago. I don't know why these people keep trying to swim against the tide, when history will show how wrong they were.

This is almost as bad as the DEMOCRATS starting the Civil War over their insistence that the Evil institution of slavery be maintained, even at the cost of bearing arms.

I think those attorney's for the State are wrong and it matters NOT whether the Domestic Partnership registry violates the ban, which it does and they will lose.........I wonder when these folks are going to wake up and realize they AREN'T going to be successful!!!

The Walker Administration's reasoning is that this lawsuit presents a harm to homophobic children.

The lawsuit challenges the state's Marriage Ban and has NOTHING to do with the state's domestic registry. The judge's ruling on marriage would not be dependent upon how the state rules on any Domestic Registry issue.

As to who would be covered if the marriage ban is found federally unconstitutional? Everyone in the state.

Walker still has aspirations for higher office and the last thing he really wants is to have to actually put forward a defense for a ban that he knows is toast.

The reality is setting in among the elected right that these bans are no longer credibly defensible (see: http://www.scribd.com/doc/212619626/Utah-s-br... ). They know their only arguments are that heterosexuals are defective and the same old state's rights canard, it's embarrassing. If they can put defending the ban off until the Supremes do in somebody else's amendment, all the better.
