Laura was gone for awhile, and I think she missed my post. Hope all is well with her family. I am going go the VA Tuesday for a C&P exam to evaluate my scars from CABG (secondary to IHD). I'll let everyone know how that goes. 6 square inches total scars could equate to an additional 10% as I read the VASRD. Very important - check your ECG/EKG evaluations. If it says "hypertrophy" or "left atrial abnormality" it can bump your IHD up to 30% from 10%- assuming you are over 7 METS and have a good LVEF. These terms are synonymous and indicate a thickening in the wall of the heart usually caused by a myocardial infarction.

HELP!!!! I'm a little confused and a whole lot worried. My husband's claim should be effective August 09 when he applied for IHD and then was denied (got a letter dated March 1 specificaly denying CAD). He then reapplied March 17th. VA says his effective date is March 17th. However, my concern is that everyone keeps mentioning letters, phone calls, etc....He has received none of these. When he called the 800# number he was told it was a Nehmer claim and it was at "Decision." What exactly are the steps (Decision, Rating, Notification)? Is this the correct order or is there something in between? I'm just confused and worried. Laura, any advice?

Has anyone out there received notification from Lincoln, NE office. Is VA calling with notification or sending letters. It seems that a call could be a scam. Are they mailing checks or doing direct deposits? I saw on VBN that someone got a direct deposit last night, did not mention letter or call. An e-mail to ask a question on VA.gov did not go through. I know that all is shut down today but my claim has been there for 3 years and you would think with AICD in place it would be a no brainer.

Guilty as charged - Sorry I had to be out of the loop for a bit. Please let us all know how you C&P goes for those scars.(My husband had a CABGx4 one year ago this month, so I'm really interested in how it goes. Thanks for checking in again!

to my knowledge the VA doesn't call you. maybe a VSO if your lucky. i wouldn't give ny info over phone if someone called me claiming they were from the VA. SEND IT IN WRITING WITH OVER NIGHT DELIVERY. anyone hear anything or receive award in writing out of philadelphia, pa. i got word but nothing in writing. today's day off for VA so it's another day delay. only about 25% people work at va are vets they are the ones who should be working today not vets. the postal service forces people to work today that are vets but no mail delivery does that make sense. i'm also a union office for APWU.

Back pay hit my bank account last night, direct deposit. Ratings letter stated that the effective date was Feb 1st. Back pay got to my account about 5 days after I got the ratings envelope from VA. This is out of Phoenix regional. Good luck.

I agree with everything you are saying, except the part about class action - because the VA is complying with federal law.

Here is a small portion of the final regulation that addresses your statement:

"We recognize the concern stated by some commenters that the
retroactive payments authorized under Nehmer do not extend to persons who refrained from filing prior claims that they reasonably believed would not have been granted at that time. As explained above, however, VA generally cannot pay benefits prior to the date of a claim for benefits.

Ordinarily, when VA establishes a new presumption of service connection, it cannot pay retroactive benefits for any period before the new presumption takes effect, due to the operation of 38 U.S.C. 5110(g).

The Nehmer court orders create a limited exception to that statutory rule for cases where a Nehmer class member filed a claim before the new rule took effect. VA does not have authority to further expand that judicial exception in a manner that would conflict with the governing statutes."

That's only a snippet of the applicable section - the whole rule is pretty verbose. However, for those who are interested, here is a link to the final regulation - and the VA responses to the public comments (where this info is found) is at the beginning.

Yes, from what you write, it appears the effective date should be August 2009. If you have not received any official contact from VA, who told you his effective date won't be until St Patty's Day? I can't say for sure what "at decision" means. From all I'm reading, these answers seem to vary from office to office. They receive the claim, and they develop the claim. Then, they rate the claim, and notify the vet of the results.

Teresa, please don't worry about not hearing anything yet. It's coming - it's just that there is a H-U-G-E pile of these claims they are working through. Please keep us posted!

I smiled when I read your post, because just last night I was sitting here thinking, "I wonder what the hold-up could be - can't imagine how we could possibly make it any easier for them."

Seems like there should be a big rubber stamp up there they could use for slam-dunk cases...

Happy Veterans Day! Going to be in lower 70's today so great weather for Veterans parade in Knoxville. My husband called yesterday and 800 number said his claim is being rated. He applied November 2009. His claim is in South Carolina. We live in Tennessee. Hope to hear something soon. This would be great for Christmas!

i had three heart attacks in one day, while on vacation in new mexico, and was transported to albaquerque(sp.) with 1, 100% blocked artery. they cleared and stented it. i was 47.
