Legal immigrants of course have rights but illegal aliens are criminals and only have the right to remain silent, arrest, and deportation.

Yes, it is a crime, but "only" a misdemeanor, not a felony. That proposal was stripped from one of the past amnesties because, well, DUH! It would have made enforcing immigration laws easier.
And Obama is giving Mexicans amnesty because he wants to votes, and to solidify a Democratic majority for decades to come.

I have, and taken the old roue 66 about two year's ago. We could not find an American Restaurant until we got to LA. Every business, fast food, was Hispanic, with a few taco trucks thrown into the mix. California has more arrogant Mexicans than in most area's. They have no intention of leaving even if everything they've done since they were born, has been illegal. They show ZERO respect for Americans. ZERO. I could care less how much they protest, they've ruined Calif. And if left unchecked, the rest of this Country.

You can wish until your back is no longer wet, you leech, but lowlife Mexicans will never, never get amnesty. The American people hate you and will never allow it. Ever.

If it is not illegal then why is it a midemeanor the first time you are caught and a felony the second time you are caught? If it is not illegal then why is an illegal alien arrested, jailed, then deported?

Unlawful presence in the US is a civil offense. It is not a crime and certainly not a misdemeanor.

This has always been the case and nothing was "stripped".

Section 1325 title 8 for illegal entry of an alien calls of no more than 6 months imprisonment on first offense and no less than 2 years for second offense. The first offense is a Misdemeanor and the 2nd is a Felony.
If people get arrested and jailed then they have committed a crime, 99.99% of the time anyways.

I did not realize that "modified" version of USC 8 was still going around.

USC 8 covers civil law. It is a simple as that. On the version going around on Topix, the words "The first offense is a Misdemeanor and the 2nd is a Felony" we just cut and pasted into the civil law. Silly isn't it.

The correct text is shown below.

I don't know why anybody has a problem with this. Treating unlawful presence as a civil offense is a good thing. We routinely arrest people and deport them the same day. The only reason why we can do this is because it is a civil offense. If it was a criminal offense everybody would be entitled to a day in court and an attorney. The attorney usually comes at the tax payer's expense. Instead of deporting somebody in a single day it would take years and be much more expensive.

Nope, still there in the goverment files.
The arresting officer has discretion to let the person self deport. If not then the criminal is arrested, jailed, and has a day in court where an immigration judge decides.
Most volunteer to leave rather than be jailed for who knows how long.

Now you are just making stuff up. There is no such thing in "government files". It is a Topix hoax.

Here is the government website.

Here's the problem. We don't deport the same day. 2ndly, the citzens pay though the nose. Since these illegals send money home; jail them w/o food and let their family pay for food or they starve.

The republican party should cater to the black citizens since Obama does nothing for them. Send the llegals home and let the blacks take the jobs.

At least they are citizens by the 14th amendment

Who ever said anything about amnesty?

The word "amnesty" has been in use since 1580 and the meaning has been the same throughout the centuries. It simply means a government pardon. Nobody has suggested any such thing. All of the proposals involve stiff fines, military service or something similar.

Do you really consider military service to be a free ride? Do you have that little regard for the troops. Or i it that you mindlessly repeat things you hear, but do not bother to find out what they mean?

By the way, who told you that Social Security is broke? I get the feeling that you may be receiving your news from non-American news sources. I have never heard an American news organization say such a thing.
