I believe the AIA ("America Invents Act") is, in fact, unconstitutional, and this question should be addressed by the Supreme Court, on an emergency basis - since so much of America's innovation future will depend on it! There are many ways in which it could be effectively argued that the AIA is unconstitutional, including its clear violation of the equal protection clauses and providing special protections for special groups of innovators.
