common law trademark

United States

#1 Apr 3, 2011
The company I work for was created around 2003. At the time the owner did not apply for a registered trademark. We sell a product that has become very popular and in recent years others have begun copying us. They are currently using the exact label that our company created. They even sell the product in the same market place as we do. Recently we filed for a trademark ,but right now the copied product is still being sold. Is there anything we can do to stop this?
