The entire purpose to getting a patent on a product is to protect someone from stealing it. Eisai has a patent on Aciphex and Teva has no business stealing Eisai revenue from this product until it is off patent. If courts begin to allow generic companies to steal products always from true pharmaceuticals companies before their patent expires, this will ultimately drive up the cost of pharmaceuticals. The cost of developing new compounds is enormous, if the branded life is shorter, then the cost goes up. Good luck Eisai, you deserve the branded time granted by your patent.

Patents drive up the cost of drugs because they bestow a monopoly on the inventor. Pharmaceutical companies are adept at extending these monopolies well beyond any rational period of protection. More competition from generuc makers is good because it reduces the cost of drugs for patients.
