The rich get richer..... how can a man who owns this business buy horse farms, vehicles, and travel all over the country for horse shows get away without paying his employees. Staying in fancy hotels like the Hilton? Hello, county, state, federal authorities. Let see some justice!

The owner / president / CEO of Xero-fax, Inc. is Herbert Headwell. While his employees struggled with getting payroll checks that bounced and having their health insurance canceled because he did not pay the premimums (but withheld the money); he was touring the country participating in horse show after horse show.

How are these people going to get paid? If I wrote a bad check at Price Chopper, I would be arrested! But so called rich people get away with way more than the average person. For some reason, I think he will be joining the rest of us after all the money runs out.

Herbert Headwell has been turned in to every county, state, federal authority that could possibly help the employees. We are still working on getting our wages and seeing justice served.

This whole situation is truly sad. For all the dedicated employees that had worked for Xero-Fax for numerous years, this was truly a tragedy that was inflicted upon by the man that we all made rich. And this is how it all ends? Left in debt, struggling to catch up, no insurance, and now the fact we can't get our W2's so we could at least get back the money we paid in, is just another slap in the face by HH (as he refers himself as). If I could only return the slap. But I am and will recoupe from this turmoil he has inflicted upon all of us. We all can rest at night knowing we put our hearts and souls into Xero-Fax and we are the ones that made that company what it once was. If that man can actually rest at night, I believe we have a true devil in our presence. When his employees have begged him for help, he responded "ask God for help and have faith in him". Well, Herbert, I do have faith in God, but you need to realize that you are not God, but yet an evil selfish man and the word God shouldn't exit your mouth. You will have to answer to him one day knowing you have inflicted much pain upon all those families. It's sad that a mother had to have garage sales 3 weekends in a row just to feed her 3 small children. The stories of each employees suffering is never ending. The mention of your name sickens me. I cant believe I gave literally 1/2 of my life to you and to only be treated this way. I pray one day you will have to pay for all the pain and suffering that you inflicted upon those who made you who you were and buttered your bread. You make me sick Herbert Headwell aka HH!!!!!

I wonder if people reading this knows how many lives were effected by this man. Can you believe he makes himself out to be a man of religion. Would a christian man do this to his employees and their families? He always lays the blame on others. Blaming the banks & his employees for his neglect to company that just a few short months ago was a thriving company. He had very loyal, hard working employees and HE threw away his company and everyone who depended on that company for employment and security for their families. If he actual was religous he should have a great fear of a higher power.

I think he is renting Sodom Hussian's hole, because he is in hiding! Why should we pay taxes for a labor board if they are impotent in stopping people like Herbert Headwell? This is the reason why this country where it is now, greed, and adding insult to injury, government wasting your and my my money on government departments that do nothing. I will kindly retract these remarks if the labor board does their job! If you cannot find him, get an arrest warrant!

He had recently listed his fax number as the Hilton hotel in Springfield, IL (Saratoga Chamber of Commerce). Nice hotel, glad he could afford it. I couldn't afford to rent a card board box with the checks he wrote me.

How do you pay taxes without a W2? On money you never received? I wonder if Herb has paid his taxes - I am sure the IRS is going to find out.

Iam sure that we have not seen the last of his inflicted pain. We are the victims and will continue to be the victims because there is NO one out there that can and will help us...... I truly doubt justice will be served. Definately NOT holding my breath.

Herbert Headwell refuses to pay me for my last 4 weeks at Xero-Fax or for my 5 weeks of vacation time I had accrued, and for money deducted from previous paychecks for Health care when our Health Insurance was already canceled. I have gone 9 weeks without any income, thanks to Herb & the NYS Dept. of Labor. I always thought my tax money and the laws in place would help employees when they have been so wronged by their employer, but apparently I was very, very wrong!.

PS: Check the Times Union in the next few days for a new story on this injustice!

We have been threatened by Herb with lawsuits if we seek similar employment, even though:(1) Herb has not paid our wages / made good on bouncing checks / or sent us our missing payroll checks, AND (2)Herb did not pay our health insurance premimums but still deducted the amounts, resulting in the policies being canceled.
We have been threatened by Herb with lawsuits if we refuse to sign the exit papers waiving our rights to civil claims against him; under FLSA #16B we are not required to sign and he can not LEGALLY request or insist that we do.
We have been threatened by Herb with lawsuits if we contact him to ask about our payroll.
Herb has told several employees that he loves court, that he has never lost a case, to be prepared to pay lots of attorney fees. That he would be receiving judgments against us.

I too, used to work for Mr. Headwell. It's true that he was born with a silver spoon in his mouth. The only life he ever knew was Xero-Fax. Xero-Fax and HIS PARENTS made him a multi-millionnaire and apparently he has squandered it all on foolishness. Putting horses before your employees is foolish in my book. Word has it he owes MILLIONS and the rumors about him buying horse farms are just contracts, he has not bought them because he has no money. He has screwed almost every state agency for escrow accounts that went belly up. I used to respect him, but after this ordeal, I have to agree with sman, he is a loser. I feel bad for the people that spent 18-20-27 years at this company who now have nothing to show for it. It is ironic that when I left, he made me feel like a loser, he said that Xero-Fax had great things planned for his Troy "Technology Park" and I was foolish for leaving. Seems like I wasn't so foolish now.
