Louisiana police use invalid anti-sodomy law to arrest gay men for agreeing to consensual sex

Jul 28, 2013 Full story: Salon.com 59

According to an investigative report from the Baton Rouge Advocate, there have been a dozen cases since 2011 in which undercover police officers in Louisiana have propositioned gay men for sex - agreeing to have sex in private, and without money changing hands - only to arrest them under the state's anti-sodomy law, which was invalidated more than ... This is an unconscionable violation of people's constitutional right to privacy and cannot be allowed to continue. Whoever keeps ordering these stings should be fired or else the department is likely to face a Federal civil rights lawsuit and additional wrongful arrest lawsuits that will likely succede. Just because the law is still on the books doesn't mean that it is valid. Good intentions? That is a load of horseshit!

I hate to say that I am glad I don't live in Louisiana anymore. Steadily it is becoming more and more of a police state and I can hardly believe they're letting these kinds of shanagans happen when there are so many other problems to be solved. What a waste of police resources and a horrible image for the state I grew up in!

How can D.A. Moore say that “the sheriff’s office’s intentions are all good” if he is arresting people ILLEGALLY ??!!

I hope ALL the people arrested for these non-crimes sue the hell out of the Sheriff's Dept. and win MILLIONS for false arrest !

I'm from New York, and I would never even THINK of ever setting foot in Louisiana or any of those other backwoods states.

They'll throw you in prison just for having New York plates on your car.

As usual, you are too stupid and too lazy to read the article, but just reach into your yellow Cheetos stained ass to pull out your latest opinions. The DA THREW OUT THE CASES, you moron.

I knew you were dumb, but didn't realize you are out and out retarded. When a kitten or puppy is born beyond wrong, they usually drown it. Too bad your old skank whore mother let you live, but it was surely another welfare check for her. Her crystal meth did NOT grow on trees!

Many cops just don't really care that THEY are breaking the law when they knowingly illegally arrest someone.

A few days ago I read an article where a New York City cop, who has already had many complaints and many false-arrest lawsuits filed against the city BECAUSE OF his arrests, arrested a few guys, KNOWING that they had committed no crime. His partner was quoted as saying that he told him the arrests were illegal, and the cop basically said: "Who cares ? the city pays out the money on the lawsuits, not me."

The people he arrested were held for almost 24 hours in jail, and then they were all released without any charges filed against them.

And btw, there IS a SCOTUS decision made long ago, where the court ruled that a person MAY USE DEADLY PHYSICAL FORCE against a police officer, if the arrest s illegal.

One case regarding this (there may be others) is John Bad Elk v. United States - 177 U.S. 529 (1900)

And in a somewhat related matter regarding self-defense against someone who is not a law enforcement officer, SCOTUS ruled in Runyan v. State (1877) 57 Ind. 80, 20 Am.Rep. 52, one of the earliest cases to strongly support and establish in U.S. law an individual's right to initiate self-defense actions up to and including the justifiable use of lethal force against an aggressor.

In Runyan, the court stated "When a person, being without fault, is in a place where he has a right to be, is violently assaulted, he may, without retreating, repel by force, and if, in the reasonable exercise of his right of self defense, his assailant is killed, he is justiciable."

Notice that the court did not say that one must be in fear of being killed, just that one s being violently assaulted. So if a guy just grabs you and holds you and says he wants your money, or he just punches you, according to SCOTUS, you have the RIGHT to use DEADLY FORCE against the person who is violently assaulting you, whether you are in fear of your life or not.

Also, as late as 2012, REPUBLICAN Governor signed into law a bill ALLOWING citizens to use deadly force against a police officer who they believe is trying to illegally enter their home.

Looks as if the anti-gays aren't happy with the Windsor decision so they are getting many to ignore SCOTUS now.
