How sad that an alleged murderer may go free because his attorny does not know how to follow the dictates of the law.

Idiots will hire this so called attorney because he continues to get away with breaking the law. Plus, his tactics may end up causing a mistrial in the murder case. He should be reported to the agency that handles attorney discipline and his law license should be taken away. That will solve the problem.

I hired this bozo once when he was a divorce lawyer. Way back then he was a complete idiot. He showed up for a hearign for interim division of income with nothing but a smile and he 'forgot' to tell me about the hearing. The ex won that battle and I had to pay her almost $700 a month interim division of income for two years. I was not very nice to him and fired him after making references to his lineage.

Unfortunately having a J.D. (law) degree does not indicate that you are a competent professional. In my opinion the NM Supreme Court should discipline this loser and disbar him so that his other cases and clients are not negatively compromised by his incompetency.

Somethings fishy here. Why not wait until after the gang member's trial. The lawyer gets probation,(pay off from the kids family) and the murdering gang mamber(family son) goes free. Nice strategy.

This might seem like an 'isolated event' committed by an individual but there are many such lawyers in Albuquerque. I'm sure we could all come up with many names; Luis Quintana..you name it.

In addition to firing him and calling him an SOB, did you write a complaint to the Disciplinary Board of the NM State Bar ? When enough of that shows up, it can help get them suspended or disbarred. Before I hire a lawyer, and I have hired several, I call the Disciplinary Board to ask if there are complaints, investigations going on. Sometimes I go in and read those files, anyone can. You wouldn't believe..... |

Benjamin Montoya Jr., 19, lives near the intersection in his parents' home. He, some friends and his 17-year-old brother, John, were outside when Delgado and his group, some of them hollering out their gang name, parked in a parking lot nearby, according to court records. Benjamin Montoya went out to meet them. Police accounts of the incident in the parking lot offer conflicting details, but when the fight was over John Montoya had been shot in the groin and the torso. Dominic Trujillo, 19, in Delgado's SUV, had been shot in the head. Delgado and friends loaded him into the SUV. Benjamin Montoya dragged his brother to the driveway, ran inside his home and grabbed the fully automatic assault rifle he kept in his bedroom, according to court documents. As Delgado's SUV drove past his front yard, Benjamin Montoya unloaded at least 15 shots from the AK-style rifle, popping tires, busting out windows and doors and piercing Delgado's legs, torso and the back of his head, according to court documents. How the SUV continued isn't clear, either, but it sped about six blocks east, swung onto Sixth Street and took a hard screeching right onto the short dead-end of James Avenue. Neighbors there remember hearing the vehicle coming. Theirs is usually a quiet North Valley neighborhood with a rural feeling. Tree-lined irrigation ditches run nearby. The neighbors a few houses away have sheep. So the scene Linda Ross and Sharon Madison saw when they looked out onto the cul-de-sac from their front yard was shocking. Delgado had been pulled from the SUV and laid face-down on the ground, his blood pooling around him. Trujillo was reclined in the blood-smeared back seat. |
