It's one thing if the victim refused to attend the preliminary hearing.....where the burden of proof is very simple. But....at jury trial, if the victim refuses to appear then the charges should be dismissed. A person has the right to cross-examine witnesses, one of which is the victim. If she will not appear, there is no way that this guy can get a fair trial and be afforded all of his rights in the court room. He may be innocent or he may be guilty, but the simple fact remains that if the victim refuses to cooperate, how far should the State take the prosecution? Doesn't it cause the victim's credibility to be severely damaged? I would hope that citizens of Rogers County would pay close attention. It could be any one of us in the future!

Starkey is wanting a grand jury. We need one here in rogers county if nothing else...but to clear the air. ANYONE who is not afraid of prosecution..but is wanting correct, honest government...should not fear..but cheer one being here.

The constitution GUARANTEES the right for an accused to face his/her accuser! What's going on in Rogers County? If Starky's accuser can not be located then he should be released and any impending charge(s) should be dismissed.

ANY ONE that disagrees with the status quo in Rogers County instantly becomes an "enemy of the state" or in this case "enemy of the counties powers to be". The question is: How far do you want to kneel and how many rights do you want to give up? Starky is right in his demanding of an open courtroom to help prevent the railroading that goes on here. He is not the first and won't be the last, until the citizens here quit crawling on their bellies and stand erect! There are those who will read this and will instantly start making nasty comments about these statements but in reality...What concious minded person can find fault with them?

This guy may be the ogre of the county....but that does not do away with due process of law. If the county is going to prosecute him, or anyone else, do it right and according to the rules. When the victim will not cooperate, and a defendant cannot cross-examine and the jury cannot hear all of the information/evidence in the case, is this what you really want in our judicial system? If he beats on women on a regular basis, then he will do it again and be arrested again. But in this particular situation, due processs does not appear to be present.

His friends say he never touched her. Look on oscn for his next court date,...BOUNDS THE DEFENDANT OVER FOR TRIAL. CASE SET FOR DISTRICT COURT ARRAIGNMENT ON APRIL 7, 2009 @ 9:00 AM BEFORE JUDGE HANEY. Go down there and talk to them. There is usually a group trying to get inside the courtroom.

So far as any of these prosecutions, we have not seen due process in any of them. It is all about convictions, or in this case about stopping the Grand Jury, and the end justifies the means.

According to your rational......if five or ten people accuse YOU of a certain crime, then no matter if you are guilty or not, because you have been charged more than once you get no due process. Is that what you are saying? What is the difference with that and the old Soviet Union, where they just locked you up because they didn't like you.......Answer?

You should read up a little further. You will find that a supporter of mr starkey first started the "dummy" name calling. They seem to be easily agitated, angry people in general.

Instead of deciding who called someone a name first, how about looking at the fact of the court proceedings. If Starkey assaulted his wife, he should go to jail. As should anyone who does this. But should a person stand trial if the complaining witnesses and/or victim refuse to cooperate in the prosecution? That is the question.

David Starkey is a nut....he might be guilty and he might not be....but since he put his hands on the attempt to get a grand jury for Rogers County, the effort has gone no where due to his personal issues. If he is a wife beater, he needs to be in jail. But I sure don't want a presidant set here in Rogers County where a person can make an accusation, then refuse to cooperate with a court proceeding that my tax dollars are paying for. If the accusation is true, and it is important to you, then bring your butt to court and testify! If I don't, the judge throws me in jail. Wake up people......this is not a third world country and we need to protect our rights when it comes to court proceedings. We would not even be talking about the Starkey case if he had not got involved in Rogers County politics and hacked off the political machine!
