Upland police investigate Moreno Valley city manager

Upland police officers served search search warrants this morning at the office and home of Robert G. Gutierrez, city manager of Moreno Valley.

Officials were investigating an allegation against Gutierrez of illegal computer access, Upland police Sgt. Cliff Mathews said. The allegation was made by an Upland resident.

Upland police would not give any more information about illegal computer access or the connection between the Upland resident and the Moreno Valley city manager.

Search warrants were served at Gutierrez's home in La Verne and his office in Moreno Valley "in an effort to find evidence to support or refute the allegation," Mathews said.

Police confiscated data from city network in Moreno Valley, documents and computers from his office and home. The high tech crime unit will do a forensic analysis on the computers. Mathews said.

No arrest has been made.

When they have finished the investigation, Upland police will submit the information to the San Bernardino County District Attorney's office for review and possible charges.

These alleged "cyber-crimes" are confusing to me, what is "illegal computer access" anyway? Why wouldn't the Upland PD be calling MoVal PD to have the raid? I guess in these days of the Police Chief and City Attorney being "at-will" to the City Manager, all jurisdictional boundaries go out the window. MoVal is in Riverside County, Upland is in SBCO., is a cyber-crime a cross-jurisdictional "free-for-all"?

"what is "illegal computer access" anyway?"

It is defined in many ways from straight out hacking, to simple unauthorized access. That said this story really doesn't state in what way the use of the computers are alleged to be illegal, it could be simply that they were used for personal business. Until they print a full accurate story we will all be left to wonder.

They are not required to do so under the law, that said however it is normal and customary to at least inform them of the action. As for at what point they chose to do so depends on the situation, such as could to much lead time result in a loss of information.

This investigation is very unfortunate. Serving as a city manager is a difficult calling at best. Insinuations, unfounded suggestion and innuendo are most often aimed to intimidate, bully and tarnish a managers hard-earned professional reputation. It seems irresponsible to participate in a discussion of this investigation when no facts have been reported. I do know for a fact the City Manager Bob Gutierrez is a highly skill and professional public manager. He is one of the good guys!
