Shame on cracker barrel...They dont care about their injured employees. They wont pay workers comp or any medical bills when you get hurt. How many people is this going to happen to before something is done.

Details would make your post more believable, Big Daddy. Who, what, where, when... all that stuff. Without them, your post is neither meaningful nor believable.

Most days you are retarded, this day I actually laughed at you rather than shook my head.

I declare today as "Dan" day.

Maybe it isn't that they don't care, but if they paid for every medical condition of every employee, then your breakfast there would cost $200 per person. Plus, McDonald's and others hold Cracker Barrel's feet to the fire when it comes to delivering a quality breakfast at a reasonable price.

That's not true. All employers are required by the state of Tennessee to comply with Worker's Com laws. If an empleyee is injured and Cracker Barrel (or any other employer) is not following the letter of the law, they need to be reported to the Tennessee Dept of Labor.

http://www.state.tn.us/labor-wfd/wcomp.html

No employer is required to provide any other insurance and a great many do not, especially to part-time workers.

So if you have a legitimate complaint, file with the state, not Topix.

Sounds like someone didn't pass a drug test. I can't see Cracker Barrel or any other business not paying just because they didn't feel like it.

"I done already have"? If you didn't do better than this with the state, I can see why you didn't win.

You obviously think Cracker Barrel should pay you Worker's Comp benefits directly. That's not how it works. An employer pays state insurance premiums and the D.O.L. oversees the administration. Cracker Barrel would never pay directly. You clearly don't know what you are doing or your assertion isn't true.

I think the only thing that the workers comp carrier has to pay directly is if you are out of work for extended time and they have to pay you the average of your salary from the date of the injury. I don't think they have to pay for anything (medical or salary) if the employee fails the drug screen.

My husband had surgery and was suppose to be off for 6+ weeks.(He was the general manager at the time). He returned to work three days later and the district manager I speak of asked him "where is your f.... tie". he had rotator cuff surgery that was a two and one half inch tear and was not released by the docs to work. Then the same day has the cahoonas to ask him to drive and get him a pack of cigarretts. His arm was in a sling to prevent any movement. Can you explain to me why he is STILL employed ?? I guess he needs the insurance ha ha Maybe the job drives him to smoke...is that a work comp issue?????

There is your problem. You cannot go to your own doctor and expect it to be paid under workers' compensation. If your personal physician takes you off of work, it isn't not under workers' compensation. Not even the Department of Labor would find in your favor. You went outside the benefits of the statute by going to an unauthorized physician. If you don't believe me, you can call the Department of Labor and speak with a workers' compensation specialist. You are wrong to blame Cracker Barrel for not paying something they don't owe.

Benefits are paid to the employee from the insurance carrier, they do not go through the State of Tennessee. The Department of Labor does have a role in overseeing these claims and can order a carrier to provide benefits.
