ME TOO! and especially when you consider that he and his sister were relying on "professionals" to advise them on HOW to do it.... IF he was wrong, and it was CLEAR that he should have done it some other way, let him pay the money (without any penalties) and let the govt go after the attorneys and tax people that advised him improperly.

The income tax is unconstitutional anyhow, we should all be doing the same thing. Ill be rooting for Helio to beat the IRS.

The income tax is not unconstitutional. Anyone filing a return (or not filing a return) claiming this "defense" is in serious trouble with the IRS and could end up going to jail. This has been litigated several times aand it is as clear as the driven snow that the income tax is constitutional. If you don't like our tax system, move to another country. Cuba has no tax system, you could move there. Good luck.

Reliance on a tax professional may be grounds for penalty abatement, but not for the paymment of tax. The return that you sign is YOURS at the end of the day. This whole scheme sounds very fishy to me, and the defnese argument supports that. "He doesn't owe tax becasue the money was going back to his father who financed his racing career??!!!" Oh, now I get it! I'm SURE Helio and his father have a signed promissory note where he agreed to repay his fatehr a fixed amoun t of money, and that the note also bears an arm's length interest rate! Sure....you should all be outraged that he's trying to get away with something like this, as the great majority of us pay our taxes in full!

Lets see; Congressman Charlie Rangle (Dem. N.Y.) Chairman of the House Ways & Means Committee "forgot" to report his rental income.--- Former Senator Tom Daschle (Dem. S.D.) "forgot" to report his taxable benefits.---- Current Sec. of Treasury Tim Geithener "forgot" to pay his taxes.---- But of course, we must have this show trial to remind the proles that our tax system is the foundation of a great nation.

Keep i mind that not all of race winnings come in the US. There are races in Canada, Austraila, South America and Europe. Even his personal services contract was signed in Brazil. I'd find it hard to beleive a wealthy, non-US citizen would be blind to the advantages afforded him by being contracted in Brazil and not the US. I'm also upset that Helio is being singled out. What about foriegn drivers being sent here to race professionally by Porsche, Audi, BMW, Honda and Toyota and not being taxed at all! Some of these drivers have contracts that pay even more than Helios' entire earnings.

this is a waste of taxpayer money. surely there are more odious crooks to go after! this is a show trial, nothing more. make him pay his back taxes and dismiss this case.
