In the meantime everyone can demand jury trials for moving violations and ordinance violations, as of right under the Indiana Constitution, and have their cases heard in the Superior Court of the county. Unless that court is too busy in which case they get dismissed. Keep in mind that a county prosecutor MUST prosecute traffic offenses.

Drivers licensing and traffic tickets for traveling in the family automobile are scams. Basically because the family automobile does not come under the jurisidiction of the Bureau of Motor Vehicles.

The BMV is a limited jurisidiction administrative agency for regulating "motor vehicles". A "motor vehicle" is defined at "IC 8-2.1-17-11 to mean a truck, a tractor, a trailer, a semitrailer, a motor bus or another self-propelled or motor driven vehicle that is operated upon a public highway for the purpose of transporting persons or property for hire". Where is the family automobile described in the definition? Nowhere if you can read!

People might be suprised to learn that when they register the family automobile at the BMV it is registered not as such but instead is registered
as a "motor vehicle" used to tranport people or property "for hire". Therefore the police officer presumes you are operating a "motor vehicle" instead of traveling in your family automobile and that you can be issued traffic tickets accordingly.

The ticket summons issued by the BMV is defective as it is not signed by the clerk and prosecutor as required by law. However the ticket summons is a "promise to appear". The "promise to appear" is fulfilled by filing in the court a motion to dismiss the ticket summons for insuffiency of service and for the court's lack of subject matter juridiction. is a privilege granted by the BMV. Traveling in the family automobile is a common right. A distinction that can be made at law if one is willing. Any takers?

Here's an idea, how about you stop writing traffic citations until you clear up the civil matters and ordinance violations.

Oh that's right, you small towns RELY on the income from traffic citations to operate. Without citations, you go bankrupt. Ain't America great?

$9,500 is an insult. City Judge doesn't require a law degree, but it doesn't pay enough for anyone to do the job. The city council better increase the salary and get a judge.

Unless it is a city ordinance violation, all traffic tickets only generate $3 for the Dept who issues the ticket to be used for training purposes only per state law, get your facts straight people so you wont look like Moron's in the future!

No its perfect. Let him see what a juror goes through. Heck he chose to be a judge. Jurors are forced. I think all judges should work for the same wage a juror gets. It is their civic duty.

Hi everyone,
The quote is actually
"For now, Ellis asked the city’s police department to stop writing traffic tickets through the city court until a new judge is appointed."
I spoke with the mayor's office, and found out that "through the city court" doesn't meant that they're not going to write tickets, but rather, the tickets will be handled by other courts or the docket will be held until a new judge is appointed.
