"Assumed"? He =did= have the right of way.
Let's look at how it really should be viewed.
The truck driver made the assumption there wasn't anyone in the intersection he needed to yield to. Who is at fault (besides the designers of the 1st Ave bike lane)? It's funny and very sad, cyclists can follow every rule of the road, every line of the law and yet people, primarily auto drivers, will continue to unfairly blame them for collisions.

"The types of crashes are listed in order from most common to least common.
1. Motorist's Failure To Yield"
Some irrational motorists love to talk about "self-centered cyclists" all the time. A bit of self-examination is needed in the world of auto drivers. Those "share the road" signs aren't targeted toward cyclists but toward auto drivers. "Start seeing motorcycles" bumper stickers aren't for us bicyclists - it's for auto drivers.
Time for you auto drivers to start looking in the mirror.
Do you think there is ever a wreck caused by the inability of the car/truck driver to see the bicyclist?

Its a moot point, he is dead. The cyclist needs to look out for bigger vehicles. Arguing over who's got the right of way is futile.
