If you had been following this story carefully, you would know the following: a) this guy is a great lawyer; b) they can't prove these accusations; c) his legal and constitutional rights have been violated by the police (their misconduct is staggering) and there's no way this is even going to get to the preliminary hearing. Truth-sayer knows what's going on. Anyone who knows the Spyrock community knows that Mark Wuerfel is an attorney that lives in S.F., owns a large ranch in the Spyrock Road area since about 1974, leases much of it to his neighbors and tenants, has some of the biggest springs in the area and allows neighbors to get water for their uses, especially in the summer months. If you know Spyrock, you know that many people grow pot there.

A fenced and gated tenant area on the ranch had pot there and a building caught fire - caused by a worker who ran away; Wuerfel was not even there that day (July 13, 2007). Wuerfel was arrested at about 6:30 p.m. while returning from the south. He was picked up and arrested with no investigation by COMMET or the DEA.

Not guilty plea was given. The only way this will be over is by dismissal or by going to trial. NO PRELIMINARY HEARING AFTER 18 MONTHS! And law enforcement has totally screwed up in violating his constitutional rights. Big time rouge cops! Who are the real criminals? Do they have badges? What do you think?

Then the DEA with COMMET led a second raid on August 6,2008 and screwed up again. Mark Wuerfel and his wife were arrested and four water business workers were handcuffed for up to 6 hours for doing their legal jobs. Since they could not prove anything, they took his criminal defense files and reviewed them to find evidence and take things so Wuerfel would not have them for his defense.

Anyone who wants to see how dishonest this prosecution is should follow the proceedings in Ukiah. The law enforcement officers and the prosecutor are about to be called out for misconduct. Fraud and perjury in affidavits for search warrants to mislead judges, false statements in police reports, violating court and legal requirements in handling evidence,knowing destruction of evidence that would prove Wuerfel's innocence - you name it, you'll find it.

No warrants - just trespass and breaking and entering. It is about 3 miles from one place to another where pot was found. Maybe they will charge him for all of the pot in the Spyrock area!

I know Mark (the shark) Wuerfel too. He helps the tribes in Mendocino County with free legal work. He helps people in need in our area and doesn't charge. He even gives water for free if people need it in the summer up on Spyrock and can't pay.

I have been following this matter for some time now. Mark Wuerfel has been completely railroaded for what others did without his knowledge or involvement in wrongdoing. Mendocino County Superior Court Judge Ron Brown has taken control over all proceedings and is being presented with the truth of what is really going on. There has been no prosecution of Mark Wuerfel in this matter - no preliminary hearing, no trial setting, etc. All that is going on is the presentation of evidence of law enforcement misconduct - arresting him for doing nothing illegal, taking his lawyer's privileged files in violation of his constitutional rights, destroying exculpatory evidence proving he is innocent, etc. The file has the best information on how wrong this all has been. Mark Wuerfel is not worried about this. He knows that the judge is figuring out who the real wrongdoers are and the need to dismiss the bogus proceedings in the interests of justice. Check out the court file. You will see how badly he has been treated and how wrong law enforcement has been in their misconduct.
