But there is nothing that states police cannot re-initiate questioning, it was his responsibility to keep his own mouth shut if he did not want to say anything against himself. The police in this case were simply doing there job and it would be completely wrong if his confession was thrown out because one or both of his lawyers is a smooth talker. You have no idea what you're talking about, do you? But, I'll give you the benefit of the doubt. What are the rules surrounding the obligation of the police once a suspect has invoked his right to remain silent? Ok, let's both admit that you don't know what the standard is. So, let me tell you. Once a suspect invokes his right to remain silent, the police may not do anything that is designed to elicit an incriminating response. Now, after some time passes, they may try again (as opposed to circumstances where the defendant invokes his right to an attorney). In this case, however, it appears that they continued to speak with the defendant immediately after he invoked his rights to remain silent. The real issue is whether they did or said anything that was designed to elicit an incriminating response from the defendant once he invoked his right to remain silent. Now, discuss.

Haven't the Miranda Rights been around long enough that people should know without being told that they have the right to remain silent. Especially if you been arrested before. Its a shame how many losers there are out there. Child molestors are the lowest of the low.

They can re-interview him and at that second time he should be read his right again, and would have to sign indicating he does not want a lawyer present and has changed his mind about speaking to police.

I think if Mr. Wilkins was molesting his own children, as far as I am concerned, he wasnt any better than mr. christmas. Also, if there were other adults within this family who knew of this behavior, perhaps they should undergo a psych eval. It sounds like they all have issues. A normal human being doesnt go around touching children or allows it to happen. If you are well at all, you make sure that you talk to someone to investigate what your thinking might be happening. And, lets keep writing our legislators for Jessica's law. We the people of Vermont, need to start giving ourselves a leg to stand on to help our children grow and to live successful lives without being in fear of those not well people around them.

I was just curious is This what the shooting was about in the 1st place? Molestation or allegations of such within this family? I pray the victim/victims were not the same chiild or children being harmed by both of these guys. what a chilling thought!

Both families have dragged through a whirlwind of emotion, heartache, loss and suffering! these constant blogs from countless people who think they know the whole situation in its entirety, are completely and utterly wrong!!!! In response to your comment about everyone needing to get their heads examined, What the hell do you know? I'm sure anyone in either one of these families would be happy to pass their shoes off to anyone to walk in them for a while!!! Don't think u would want to ! Please stop this!!! Enough is enough! Nobody is to blame here except for Michael Christmas! Let all these children and two families try to return to a life as close to normal as they can!
