What has this company done to deserve this action? They have been doing what every other company in their line of business does. They didn't start the site, they bought it already in use. Since the issues of POSSIBLE collapse have arisen they've worked with the government agencies even when it hurt their profitability. Yet now they face this? All because something MIGHT happen? The law requires that there be some harm actually occur, and that piece of the puzzle seems missing. And no, I'm not related nor do I even know any of the principals in the business; I do recognize a scapegoat when I see one, though.

I'd suggest reading the compliance order before you get too much on the "mean, nasty government picking on poor little I&W" bandwagon.

I'm sure government=bad, business=good is a simple and compelling emotional way to view this particular case, but don't let the actual facts of the situation get in the way.

Well perhaps you should "educate" yourself on principles, facts, etc pertaining to this prior to your next boo hoo post regarding poor IW.

The city and state collected taxes and fees from I&W and previous owners for over 30 years. Are they not also responsible for the problem?

Were the two wells that collaspsed also not in compliance with the regulations prior to their fall in? And if so, what's up with the regulators (OCD)? How can OCD issue an annual premit for operation when the a well isn't in compliance? Seems like OCD doesn't know their job. Did Jim's Water Service and Ray Westall get slammed with fines for their brine well collaspes, I haven't heard that they did. Seems like I & W is being made a scapegoat.

Well, for starters those 2 other forementioned brine well collapases were not located in close proximity to major highways. Nor were they located by numerous businesses, residences, et. al. I & W isn't being made a scapegoat. They should, at the very least, be partially liable for the cost(s) incurred to monitor its well and the cost to assist in preventing its collapse.

Because they don't read the reports and test results that they requre operators to submit...and they admit it. Go to the Santa Fe OCD office and you'll typically see 4+ years of reports in boxes beside a desk.

I AGREE. i do not know them ether. but i know a bunch of vultures circling above for something easy. AND that is all they are. i buy all my livestock feed at circle s cus its the only feed store in town. but in my opinion the old man seems to be real predigest. and i agree wait till something instead of wanting there chickens before they hath.

This is the biggest political gang bang I've ever seen. Instead of going after the OCD(the arbiter of this debacle), the city joins forces with them to pin the blame on a local trucking company. Sure, I&W was being naughty in their land-rape, but they were doing so under the wing of the OCD. They were operating inside the law until the OCD started making ridiculous demands on them that they couldn't possibly live up to. Now, thanks to the taxpayers, the city has the legal and intellectual firepower to pound them into the ground and the air-head judge shuler will fall for it hook, line and sinker. In the end, it is the working-class employees of I&W who will suffer.

My entire post started with a question, so first of all get down off of your high horse and educate me. Then quote me one "principle, fact, etc." that is clearly and solely I & W's fault. Where did they break a rule or a law? What have they done that makes them responsible for this POSSIBLE problem to the exclusion of any contributory actions on the part of the state and city? And that hasn't been part of the standard practice of similar businesses? Those are the issues I was raising, not "boo hoo"-ing I & W, whom I know nothing about. Oh, and before you set out to educate me, where do you get your expertise to do so?
