Bovee sought reimbursement for the PHA program several times from Excellus BlueCross BlueShield, but Excellus never approved the program as a rehabilitation provider or issued a provider number, said Blues vice president of communications James Redmond. Like other area gyms, the PHA health club had been paid under the Blues Healthy Rewards program, Redmond added.
The Bovee brothers opened the PHA club in 2004, locating in a storefront at the Winton Place plaza on the Brighton-Henrietta town line and running it there until the club closed. The health club was small but featured a full range of workout equipment and a juice bar where patrons could also take shots of pure oxygen. It also offered individual personal training sessions with the Bovees and other trainers, as well as spinning, yoga and other group workout classes.
In 2008 and 2009, lenders, owners of workout equipment leased to PHA and the plaza's landlord sued the Bovees, seeking payment of debts piled up by the club. Judgments currently filed against the brothers total just under $1 million.
Judgments on file in Monroe County against the Bovee brothers include a $475,000 action filed by Winton Place LLC and actions totaling approximately $178,000 filed by several lenders. Suits filed by JPMorgan Chase & Co. and RBS Citizens Bank are pending in state court locally.
The Bovee brothers' bankruptcy filings identify a California lender as having obtained judgments against them in a California state court. The bankruptcy papers list debts owed to that lender totaling some $427,000.
Genesee Regional Bank-the holder of a $54,080 lien on the Bovees' assets-has filed paperwork to garnishee Robert Bovee's wages but has not yet taken money from his paycheck, Robert Bovee's bankruptcy petition states.
Robert Bovee's petition gives his and his wife's 2010 gross household income as $131,781 and their net monthly income as $1,897. According to the filing, the heavily mortgaged $155,000 Brighton home he shares with his wife and two sons accounts for most of his declared assets.
A roughly $40,000 interest in a home in Liverpool, near Syracuse, inherited from an aunt and occupied by the brothers' septuagenarian parents accounts for most of Rick Bovee's declared assets, his bankruptcy filing states. His bankruptcy petition lists Rick Bovee's 2010 income at some $48,000. The filing states that his and his wife's combined gross annual income is $84,660 and their monthly net after expenses is $63.55.
