Cocaine was once a legal product that was made illegal across the nation, even though it may have been incorrectly classified as a narcotic rather than a stimulant, it still was the victim of federal prohibition based on societal issues.
As far as using the civil war as a sort of fear tactic, well its really a stretch to gain support.
In fact, the civil war was a result of 11 states that decided they were NOT going to follow the national rule. Anarchism was and is NEVER tolerated in a civil society, and as a result the confederacy was squashed like a bug!
Civil unrest will not be tolerated, and smoking is a form of that unrest that is being squashed out.
The pendulum ALWAYS swings back, and smokers have dominated the "control" for way to long. You will see (within your lifetime) national reform to remove smoking from confined public places or places open to the public, as well as from exposing children to the smoke.
Think that won't happen...then I suggest looking at the history of this country!
Nevertheless, states rights trumps as the reason Hillary Clinton and any other nanny politicians back away from a national smoking ban. States rights was a hard lesson to learn via the Civil War, no matter how long ago that was. It would be a hard lesson to relearn today.

Intro:

The American Cancer Society Tuesday was allowed to become a party in the lawsuit questioning whether opponents of South Dakota's smoking ban got enough valid petition signatures to refer the issue to voters.

That will allow the ACS to make the case that the smoking ban passed by the Legislature this year but not yet implemented is not subject to review by voters.

Product of fraud...assuming you mean the majority of Ohio voters overwhelmingly voting for smoking bans, I would again say...the ends certainly justifies the means. I also think those responsible should be punished to the fullest extent of the law.

I have an M.D. from Harvard. I am board certified in cardiothoracic medicine and trauma surgery. I have been awarded citations from seven different medical boards in New England; and I am never, ever sick at sea.

So if people are knowningly violating the rules, why dont the bar staff ask them to put out the smokes and if they refuse, kick them out. Sounds easy to me.
