Its about time, so many of us non-smokers have had to endure the gross second hand smoke that smothers our food and drink...ugh! The restaurants will be busier than ever now!

Nobody forced you to eat at a place which allows smoking.

I don't smoke and stay away from the places which allow smoking, but that's MY CHOICE along with the choice of the owner to allow it. It should not be the governments job to make businesses ban smoking. It should be the owners choice.

Once again, they think they have to play the parent role and take away our own ability to choose what's best for us.

We need to ban the government.

What the is going on here? WE can't smoke, we can't drink whats next, we can't afford gas too?

I think it is stupid that we can only smoke in places the the Governement wants us to. If a bar or a restaurant whats me to smoke why can't I? If a a bar or a restaurant doesnt want me to smoke so be it. It is just like propsial 8 in California, its okay then its not ok, wtf is going on?

Haven't we all been down this road? Its like deja-vu!

I am not being or asking for nasty, and welcome a rational dialogue. In that, I would ask, why should I have to leave my favorite restaurant just because someone cannot wait a an hour to smoke?
Bars no problem, but an eatery...really? Honestly, one hour is nothing? Some go 6 to 8 hours without one when they sleep, and we know most don't smoke but every couple hours or so at work...so why is it the uncontrollable need to chain smoke up to and including the first bite, then after clearing a plate of food, firing up right away until bill paid and person leaves.

Outside, in bars, at a persons house no problem I say, but in a place where people intermingle in order to do ONE thing which is eat, it is not fair to those that are bothered by it, and it is wrong to simply say "dont go there if you dont like it", as unrealistic as it is for someone else to say, "just quit".

Since it is open to the public, even being a private business, certain rules and guidelines do and must apply.

Would you be willing to use your right to freedom of association by going where there are others who are like minded...or do you seek to force all to cater to your lifesyle of choice?

Would you force the owner of the property to change their LEGAL lifestyle of choice on their own land...all to suit your desires?

Wahoooooo!!! My biggest customer is in MI and I absolutely HATE it when I have to do onsite visits there because of the smoke in the restaurants and bars. None of the employees of my customer smoke, but they have just not experienced how pleasant it it is to go out to dinner and then perhaps a piano bar or whatever, so they just accept it. Now I can go there and actually enjoy wining and dining them! Each day is better than the last because each day I read that another state has passed a smoking ban. Happy Contented Soul - go suck an egg you fool! Today is a GOOD day!!!

At a time when the bans increase the electronic cigarettes hit the market. There is now an answer to second hand smoke that we didn't have previously. Many will say these are unproved and we all know how safe tobacco is right?? I have been using the Freedom and Classic from ezcig, for 6 months and find it very satisfying and so far have not had any problems using in any of the restaurants, or any other estabishments. I might get a curious look or two, nothing more. Because there is no smell, it's easy to puff and not even be noticed.

Who said you can't smoke? Smoke all you want if you're stupid enough, JUST stay outside or at home. Times are a changing, buddy.

Who said you can't drink? Drink all you want just don't drive or walk around public staggering all over the place.

When a legal product has potential hazards then yes I want the government to make restrictions to make us all safer, cleaner and healthier. It's called a CIVILIZED society! That's why I vote to keep people in office that will look out for the well-being of my family and I. What a country!

Since when do most bar owners know what's best for their customers? They only look at the bottom line, the almighty dollar. I'm glad the health inspector and fire marshall and liquor board inspectors, etc, check things out to make us safer, cleaner and healthier.

Sorry you have to step outside to smoke but it's best for everyone. The patrons, the employees and yes even you as you won't smoke as much. A win win for all.

I think you should shoot for at least contributing something relevant in 1 out of 10 of your posts. I know...it's a stretch, but if you take the butt away from your lips for 5 minutes, I have confidence that you can come up with something.

If you could pull your head out of yours, you might be able to contribute something useful to Topix, or perhaps society in general. However you've made it perfectly clear through months of your inane drivel that none of that will ever happen.

So sad...

Oh brother...we have another self righteous moral busybody on our hands who has failed to see the obvious.

Tell us oh self righteous one...when the owner of the property is forced to change their LEGAL lifesyle of choice on their own land...even in their private office all alone...what loss of rights would you quote?

When like minded individuals lose the right to gather together indoors on private property to enjoy a LEGAL lifestyle of choice...what loss of rights would you quote?

Can you site precedent for such insanity from our nations past that you are particularly proud of? Try not to confuse LEGAL and illegal as you socialists seem to have real difficulty comprehending the difference.

If your kind can now do this to one LEGAL lifesytle of choice...what protects others if you turn your self righteous sights on them? What a dangerous precedent indeed... if this madness is allowed to stand.

Because you don't own the property and its the owners right to choose smoking or nonsmoking and the public will make its own choice to enter or not enter

Privately owned business property is not public property or public domain

Public property is property which is jointly owned by a whole community of individuals or by a non-communistic, dictatorial, or totalitarian government

as apposed to

private property, which is owned exclusively by an individual or individuals jointly that do not constitute the whole community.

In the modern representative democracy, "public property" is synonymous to state property, which is said to be owned by the people as a commons. In many Commonwealth realms, such property is said to be owned by the Crown. Examples include Crown land, Crown copyright, and Crown Dependencies.

Most public property is accessible to the general public, such as zoos, libraries, schools, and parks; some is reserved for restricted use, such as military bases and research laboratories.

no, the owners still have their guaranteed private property rights, you the public have no rights except to accept or refuse the privilege the owners offers you to enter or not enter their doors. Nothing has changed, we have been through a Hitler period before with his smoking ban and others which have all failed, this will be no different

You are incorrect sir. A private business such as a bar cannot do what they want.

They cannot:
-serve anyone under the age of 21,
-offer topless waitresses unless without special permission,
-have bottomless
-stay open past 2am unless they have special permission.
-serve liquor before 12 noon on Sunday
-have gambling

If the ban goes through, they will not be able to have smoking as well.
My point is, regardless of the private business argument, if the law says no, then it aint happening.

On that note I will again say LEAVE THE BARS ALONE! Restaurants and other businesses, go outside. An eatery is there to provide food and that's pretty much it.
In the case of a bar restaurant I think restrictions could apply during typical dining hours.(in my opinion)
Its about compromise, its what our whole society is about.

1. they agree to rules for the age for serving alcohol for the liquor license which is required to serve alcohol.

2. if they wish to have topless waitresses are you saying they can get permission? Looks like they can offer boobie waitresses if they want to

3.bottomless, what restaurant wants to have bottomless? I have not seen any begging for that

4. but they can stay open past 2 am if they choose to

5. Sunday liquor laws vary, but wat does that have to do with smoking. The owners agree with the liquor laws

6. ever heard of Keno?
