Personally I would hire a good lawyer you will have to wait, but should settle for a lot more then just what Zimmer will offer. We have been on this since Aug. and still haven't heard from Zimmer as to what they are offering.

Well if I understand the comments on some of the other posts:
- The offer may between 100, 000 and 150,000
- The Legal Team gets 33% plus expenses
- The insurance company gets paid back for the revision expenses
- The patient gets ??? Not much...

I didn't get anywhere with my attorney during mediation with Zimmer. Nothing firm was offered but numbers like $200,000 were brought into the conversation and we walked out of mediation and I am filing a lawsuit although the head mediator tried to tell me I will not win because non of us can "prove" that the zimmer cup did the damage. So unless your attorney is willing to go to trial, you might as well as try to get that amount without an attorney.

Our office recently filled yet another Zimmer Durom Cup lawsuit covering many of the same issues that you all have and continue to deal with on a daily basis. For those of you who have not settled you claims for the low settlement offers made to you (good for you) but please be advised that the statute of limitations may be rapidly approaching given the first time you discovered or was told you had a defective hip (this is commonly called the discovery rule-many but not all states follow this method). Those of you waiting on offers (without the filing and service of a lawsuit) need to be mindful of this because if your statute of limitations runs during this time you will likely be forever barred from asserting a legal claim against the Zimmer related entities.(And yes, they will likely withdraw any previous offer on the table once this happens)
We recently came across this issue with another client whose case and lawsuit was filed just in time to avoid his statue of limitations from running. Had he waited to call us one more week, he may have been forever barred from asserting his claims against them.
If you have not discussed your statute of limitations with an attorney that handles Zimmer Durom cases, I would strongly encourage you to do so right away. There are a few firms like ours that handles these claims on a nationwide basis.
While I can not comment on settlement values due to confidentiality agreements, I think those of you resisting low offers mentioned herein are certainly on the right track. The values vary greatly based on medical expenses, the number of revisions involved, the lost wages a client has sustained and varies even more so if the implant device was not properly preserved for storage and subsequent testing. There are a ton more considerations on this issue but that is all I can say publicly.

I do have to agree with Mr. Smith concerning being "forever barred from asserting his claims against them.
If you have not discussed your statute of limitations with an attorney that handles Zimmer Durom cases, I would strongly encourage you to do so right away."

I truly don't understand why some of you would keep waiting to see what others are getting in a settlement since waiting is only hurting your case!You need to act immediately to protect your rights.

Hi my name is Steve Aldred and i am soon due to have my hips replaced in May and u can be a part of the Canadian Class Action Lawsuit, my lawer i called months ago was only handling the Johnson and Johnson Depuy and now they r handling the Zimmer Durom the law firm is called Stevens LLP in Tontonto, hope that helped..

I have a Zimmer implant (2008) Versys system titanium w/polyethylen liner non cement plasma sprayed & I feel awful. I strongly believe I have metallosis & discussed it with my doctor but she doesn't know where to send me for test! I have painful abrasions in my eyes. My forehead down to under my eyes are in pain.It feels like a weight is on my head. Hearing loss and ringing in my ears always sometime the ringing is very loud. Shoting pain through my head and ears.I wear glasses and the arms from the glasses on my ears hurt. Nauseas & dizzy. Memory loss inability to find words, no comprehension. This happened first now my hip is bothering me when I sit or bear weight on it. Or just all the time. My buttocks, thigh (in & out) hip hurt always and I get a dual groin pain. The operating surgeon said I had bursitis and would not treat it? My doctor doesnt' know where to send me for a metallosis test. My research shows me that these symptoms are from the liner and metal scraping releasing particles in my blood. I get a 2nd opinion next month. Anywond out there share this?

I filed my my claim towards the end of 2009. Zimmer offered me $100K and I turned it down. My attorney says he can not disclose to me what previous settlements have been due to a non-disclosure agreement with Zimmer. I suffered for 3 1/2 years from that implant and had to undergo another surgery. It's going to take alot more then $100K to compensate me

Is anything happening in Canada with Zimmer on Durom?

I am not having a lot of luck because I had my Zimmer on Durom removed due to a psuedo tumor that formed. The tumor formed due to the metal ions and my Zimmer is in a lot that is being looked closely at.

Most of the Canadian cases are linked to dislocations and failure of the new zimmer to adhere.

I had to have my zimmer revised because the psuedo tumor had the potential to dissolve bone.

The hip they replaced my zimmer with dislocated 3 times and had to be revised. Then I ended up with femoral nerve damage that is very slowly healing.

Hello wendy im from white rock i to had the zimmer durom put in aug 13 2008 yup 5 months after they recalled it in the u.s ,why my doc didnt know about the recall ,i will never know ,as for pain i have pain shooting down my leg and across the groin , i can only walk a short distance , when driving my butt hurts , hope we all get what we deserve and klien lyons takes them to the cleaners

Had my hip resurfaced in April 2008 in Glasgow Scotland. A Durom Cup was used. Had pain since op and after various ultrasounds and MRI Scan which showed up nothing a special blood test was done which showed elevated colbalt and chrome metal ion readings. In October 2010 it was decided to remove this device. December 2010 now had revision to ceramic THR feel a bit better. Anyone in Scotland or UK got problems with Durom. Trying to get a class action against the company.

I had the same op in Dec 2010 in Glasgow. What was your pain like? I am still getting some pain, almost like a nervy nipping type pain. Not sure what to do as have heard about the problems with these types of joints

Sorry to hear aout your struggles. It amazes me that any surgeon would use this type of replacement at this point in time. I do not think the surgeons at VGH are using them any more. I had my done in Vancouver.

A lot of people are in pain here. My wife had similar issues to many of you. I am lawyer and I took a few important steps and it was determined that she had sciatic nerve damage after the hip replacement with zimmer.

We immediately took legal action and were compensated $200,000 for revision surgery.

It was surprisingly easy...we took one simple step that made legal action possible and smooth. Now my wife is doing better than every before after her revision surgery.

What op did you have in Glasgow Dec 2010. Was it a metal on metal Durom Resurfacing or a Total Hip Replacement with metal?

My pain with the MOM H Resurfacing was in the groin and could not lift my leg up very high while I was either lying, sitting or standing and also could not reach down and buckle my shoes (could do before op). I got my first op done at Gartnavel Hospital but since Oct 2010 I think the Orthopedic Dept.have now stopped doing MOM Resurfacing or they tell you about the metal ions etc. first then you decide what you want.

If you have a MOM Hip Resuracing Op you could go to your GP and ask to be referred to the hospital (Ortho) to get a metal test done to see what your metal ions levels are. You can then speak to a consultant about your worries.

My Total Hip Replacment is CERAMIC got this done again at GARTNAVEL Dec 2010 and feel a lot better can now lift my leg a bit higher, can get in and out car either driver or passenger a lot better, can turn over in bed no pain so yes feel a lot better incidentally still cannot reach my buckles - not too bothered now about that as I feel better.

I am due back to the hospital 13th July for results from a recent ultrasound - got this done in May as my consultant told me I had fluid in front of the hip which he noticed when doing the revision to ceramic. Also at this visit I am going to ask him if the device I previously had in is one of the problem devices. Will update you if I find anything out about faulty devices.
