DoNoHarm, I agree! But, for anyone to be prosecuted, it will take a major investigation into exactly who made the call as to notification or no notification. The NYS DOH and the NC DOH are absolutely culpable. No governmental official, DA or otherwise will have the courage to tackle this. I guarantee it. I attended the hearing at Farmingdale U.chaired by Sen. Kemp Hannon. It was a "horse and pony" show! Dr. Daines (NYSDOH) could not have cared less when Sen. Marcellino was hammering him with questions. Marcellino showed Daines no respect, and I don't blame him. Sen. Fuschillo tried to remind Daines that "we are talking about human lives!" Again, Dr. Daines was not moved. These beauracrats are like robots. They have no people skills. Hannon has his own problems. He sat on information about a Long Island health hazard for 3 years, and never said "boo".NC DOH Dr. Greenberg did the same.Five days before she paricipated in the 5/30/06 conference call about reporting the syringe scandal to the public,she sat on a dais which was allegedly a public hearing to discuss another health hazard scandal. Incredibly, not a single member of the public was at the meeting. The reason...the public was NEVER notified. She knows it!She sat there and didn't say squat! So did the NYS DOH.No one said "Where the heck is the public"? I can prove it. I shared this info. with very interested journalists at the Hannon hearing. Newsday will have their hands full for a while. Let's see Kemp talk his way out of this.Greenberg should have been fired already, but she wont. She'll probably be promoted.

There is the attitude that will keep doctors from having to be responsible for their actions. The time has come for the New York State and Nassau County Departments of Health and any agency who will listen to be inundated with complaints verbal and written. Contact your legislators and follow-up with all of the people you contact and continue to contact them. If you want to do it anonymously, so be it, but take action! Maybe this is the wake up call that was needed for this matter to come to the forefront. Keeping our mouths shut will only make us responsible for the patient after us who is mistreated. Sleep on that.

You have more information than I'll ever have. Mired in information has never been a strong point with me. I like to cut to the chase..When is he going to lose his license? When is he going to 'pay' in some way for using tainted syringes? When are the other involved going to lose their jobs and 'pay' in some way as well? I don't know names other than his...gets too complicated.

This man needs to be an example for all doctors - you breach your hippocratic oath and you are punished. He needs to lose his license, he needs to face his accusers and he needs to feel the consequence of his actions. He needs to know that he will not be able to practice medicine anywhere again. Also, why don't the insurance companies who paid for these procedures get reimbursed? The threat of losing money already collected should be another deterrent.
He isn't the first doctor to breach the oath and probably won't be the last, but hopefully his example will prevent all those even thinking of cutting safety procedures and corners that lead to potentially harming patients to think twice.

I keep posting this but NO ONE IS READING!! HEPATITIS C IS AN EPIDEMIC. EDUCATE YOURSELVES!
~~~~~~~~~~
I posted this on another site about this same story but am posting it again because it seems that NO ONE IS LISTENING!
~~~~~~~~~~
Well now that so many of you have expressed your outrage at the doctor (we might never know the *real* story) I would like to challenge you to learn a little bit about Hepatitis C! Don't misunderstand as I am also appalled that this could have happened in this supposedly enlightened day and age of universal precautions. Perhaps all this happened (sadly) so that more of you might get educated about Hepatitis C! It is reaching epidemic proportions in our country and most people don't know the differences between Hep A, B, C, D, E and G.

Hepatitis C requires a blood to blood transmission. It is the most common chronic blood borne virus in the U.S. today. There are an estimated 5 million Americans with Hepatitis C (FIVE times more than HIV) Bet you didn't know that! Only about 1 million know they have it. It is the leading cause of liver transplants in the U.S. 2/3 of patients will die waiting for a liver transplant because there are not enough organs to go around (please sign your donor cards!)

You should be tested for Hepatitis C if you:
* received a blood transfusion or solid organ transplant before July 1992
* were notified that you received blood from a donor who later tested positive for hepatitis C.
* have ever injected illegal drugs, even if you experimented only one time many years ago (or snorted any drugs)
* were a recipient of clotting factor(s) made before 1987
* have ever been on long-term kidney dialysis
* have had tattoos or body piercings
* had sexual activity that involved contact with blood
* have had vaccinations administered with pneumatic jet injectors
* are a veteran (especially Viet Nam)
* have shared razors, toothbrushes, nail clippers, tweezers, etc. with an infected person
* are a health care worker exposed to needle sticks or first responders
* also 5%-10% of babies born to infected mothers will get Hepatitis C
* have ever been incarcerated

Doctors do NOT test for Hepatitis C on annual physicals or routine exams. You have to ASK TO BE TESTED!

You do not have any symptoms that damage is being done until the latter stages of the disease and that can be from 10 to 40 years! There are treatments for Hepatitis C that are 45-80% successful depending on your genotype.

There are an estimated 4 million of you walking around with it that don't know you have it and can be inadvertently spreading it. Whether at the beauty salon where an HCV+ person was nicked and then you were nicked with the same instrument (Hep C does not die when it hits the air unlike HIV) and can live on surfaces for up to 4 days plus. Ignorance is not bliss.

Know your Hepatitis C status!
GET TESTED!

Would you feel guilty if you found out you were in fact positive and might have put other people at risk over the years?

Please GET TESTED for HEPATITIS C! It is a simple blood test and can be added to your routine tests the next time you see your doctor. Just ask him/her to add it! Take care and be your OWN advocates.

I think anyone at risk for any reason (even tattoos) and those that are pro active with their health...will get tested. You have to be living under a rock in the tri state area not to have read this story about Harvey Finkelstein. People who even think they are at risk for HIV or Hep C. will take action (or not). The percentage of people who read these posts (or those that post) is small....if patients aren't aggressive -then no amount of posting will be of any help.
Thanks for your concern.

Really? Well, I was diagnosed with a condition and then sent to Dr. Finkelstein for pain management as another option before surgery. I needed a diagnosis from my doctor so that Dr. Finkelstien - a pain management doctor - knew what and how to treat me. I don't think that just anyone can walk into a pain management clinic and expect treatment without a diagnosis or referral from another doctor. In fact, the insurance companies insist on it! Perhaps, you should brush-up on your protocols. And so you know, I have spent many hours making speeches in Albany, visiting legislators and speaking with superiors successfully reforming legislation in the healthcare field. Your negative experience might come from your negative attitude. You are justifying your actions or lack of actions and condoning others to do the same because you had a bad result...perseverence is the key to change. How nice it must be for people like you to sit back and let others do all the work and then complain when nothing changes. You are a Monday morning quarterback!

Thanks for your presumptions about my economic, education and etnic status. You are wrong on all accounts. You are another "genius" who doesn't understand IP locations.

All I was saying that the same risks that exposed this person to HIV also exposed him to the possibility of Hep-C, therefore the far more likely event is that he contracted Hep-C as part of those behaviors. An educated jury would have ocncluded the same.

I have not received a transfusion or engaged in any of the risks associated with contraction of Hep-C (tattoos, transfusion, drug abuse, risky sex), so I appreciate you wishing this on me, but it likely won't happen.

You appear to know the victim. How did he contract HIV? Was he a drug abuser? gay? hemophiliac? Of course there are other ways to contract HIV, but those are the likely ways in the U.S.

REALLY So you used your private insurance and they offered you epidural steroid injection to resolve[masked] your pain caused by a mechanicle failure in your spine.I am on WORKERRS COMPENSATION and was also offered the same injections a series of three each to my cervicle,thoracic and lumbar.That would be a total of 9 INJECTIONS OF FOOLS JUICE.Knowing the potential for long term side effects and the fact that this will only mask the pain,Knowing proper PROTOCOLS AND THE VAGUE language of the diagnosis WHY did they not order a series of three inj to the C5 NERVE ROOT,T 6 NERVE ROOT AND THE l 1 nerve root which would be specific to the injury sites I TOLD THE DOCTOR WHERE HE COULD PUT THOSE NEEDLES and walked.Last month they ordered a C56 FUSION FOR MY INJURY SUSTAINED 9/7/01 [did you mention perserverence}ONE OF THREE FUSION I WILL NEED.I have been in the senators and the legis;tors offices a dozen times in the past 3 years before it was fashionably to do so.just as i was for the past decade to advocate against system wide abuse in the agency I WORKED FOR[ omh]I paid the price and know the repercusions that my family endured for my advocating.You have but one little episode in a doctors office and now its your 15 min infame EGO

Dr Finkelstein Is A Great Doctor. This Is A Witch Hunt. Every Day In The News, You See A Doctor Who Does Not Have A License, Hurts, Deforms And Or Kills There Patients; You See That On The News For 1 Day. For Example, The Dentist In The City, He Had No License, Left His Patient In The Street, Never Called Any Of Her Family Or Called 911, He Just Left Her To Die.

Dr Finkelstein Follows Every Professional Safety Guideline. I Never Received A Letter, But Yet I Went To The Nassau County Department Of Health And Got Tested. I Came Back With A Complete Clean Bill Of Health. I Had No Doubt In My Mind That My Testing Would All Come Back Negative.

These So Called Infected People, Maybe They Should Go And Look At There Past. Did They Have Tattoos, Unprotected Sex, Drug Problems Where They Shared Needles? These Are Skeletons In There Closet That They Do Not Want There Family To Find Out About, And Lets Just Join The Band Wagon And Try And Make A Fast Buck By Wrongfully Accusing Dr Finkelstein.

Dr Finkelstein Is A Great Doctor. He Has Made Me Able To Walk Again. He Is A Truly Caring Doctor. It Is Time To Stop And Leave Dr Finkelstein Alone. Enough Is Enough, Let Dr Finkelstein Help His Patients That Truly Need Him.
