We wouldn't have this problem if heroin was sold legally, subject to the same pure food & drug standards as the (often questionably effective and equally dangerous) drugs the major pharmaceutical companies have sold forever.
And if someone came up with a drug that would suddenly make drug war proponents wake up and smell the 100-year-old coffee, it would probably be banned at once......at least until traditional investors figured out how to make a profit from it.

So many ODs are unintentional & result from non-standardized drugs. If legal (or at least decriminalized) they could be pharmaceutically regulated
Punishing the seller is rather dubious,(unless he was selling to a minor) surely the responsibility lies with the user who would have likely known the risks
