Booo! With the new fitness center in the Jefferson School, the Y is no longer needed in the city. Put it out in the county and leave the park alone.

The bigger gyms prices in this town are way overinflated. Just loaded with old Albemarle county trust fun money. They are all gonna come back down to earth real soon when members start dropping like flies and flock to the new and affordable options. Their cockiness will soon be stiffeled..

I still find it humorous that places like ACAC used members' money to attempt to halt a competitor who could actually provide similar services for much less money. It is like a union who uses its members' tens of thousands to support a political candidate who it anti-union.

So, let's see...what will happen if a YMCA opens in town? Competition will force prices downward. I hope ACAC members are appreciative of what their exhorbitant fees have been supporting during these past couple of years.

The park is there only because when the roads were built, no one wanted to dig up the big hill, so, the roads go around the hill. Today, the hill remains only because the lousy roads already go around it.

"Environment"? I don't the the planet will die because of this tiny project.

The fees the Y is proposing are not that much cheaper than the private clubs and are more than Smith and Crow rec centers. The Y will be primarily be serving county residents so it should be built there.

If the much-needed Y is finally getting built, is it possible that construction of the Meadow Creek Pkwy/McIntire Rd Extended and 250 Bypass interchange will be next? Perhaps there's hope after all. Only Charlottesville can generate so much protracted heat--and legal costs--over projects that other locales would deem vital to a developing community and a world-class university. As for the usual save-the-park ranters, there's a splendid botanical garden project in the works, so let's cross our fingers that it doesn't also raise their ire. As for the Y, let's now give it our full we'll actually see it open in our lifetimes.

This is great news! Most of ACAC staff are so arrogant - plus scandals galore. You simply cannot get parking downtown, twice I have simply had to drive home as they couldn't accommodate me as a member. Shame on you ACAH this entire endeavor will bite you back HARD! Bring on the Y asap!

ACAC's lawyers are incompetent, and in their post-ruling spin misrepresent what the Va Supreme Court decided. ACAC says they are happy the Court took the case in order to review the merits, but the Court did just the opposite -- it took review in order to rule that there was no jurisdiction for the cases, ever, and to hold that the suit was never properly filed and that Judge Higgins should have thrown them out without ever bothering to address the merits. Three things should happen as a consequence of these frivolous lawsuits -- first, the city and the county should be reimbursed by ACAC and Golds for the wasted resources they had to expend in defending these bogus suits; second, ACAC and Golds members should get reimbursements from their gyms for any extra fees they had to pay to support the litigation; and third, whatever fees ACAC's and Gold's lawyers pocketed for this massive waste of time should be donated to the YMCA to be used to accelerate the stupidly delayed construction of the sorely needed new Y.

What could this look like is 5 years?

1). It works well, good use, financially sound. Best possible outcome and the lease renues automatically after 40 years. This occurs in violation of State Constitution limits on public property lease. Fight it out then.

2). Cannot garner enough membership support. The it defaults an the City legally, per the ground lease, inherits an unused vacant building in their park.

3). The "Y" becomes a bad neighbor and the City cancels or does not renew the ground lease. Well, per the lease, there will be an appraisal of the building and the City will owe the "Y" 90% of that number. So the "Y" can take the money and run. The City again has a vacant building in their park.

You see the City gets all the risk. Did anybody question city council?

As 'Lawyer' suggests, I really hope that one of the parties to the lawsuit of the Y does pursue legal action and recourse so there are some real financial consequences for this frivolity. This was clearly a well thought-out business strategy by Wendel. Best outcome, he figures out a way to sway the court to rule in his favor. If this is the worst outcome, it still bought him 4 years of monopoly and he was able to raise additional capital to built his new facility in Short Pump. He has penetrated the larger Richmond market and can better weather the coming storm in the Charlottesville market. A rational strategy, but immoral in my opinion. Please somebody make him pay.
