ANY individual (or their family) conducting criminal activity shouldn't be able to sue for any injury resulting from that activity. But personal injury lawyers would never let that happen.

Agreed... Here in Tn if you shoot in self defense and it is legitimate you are immune from civil suits as long as you did not cause harm to a 3rd party.

I agree, and a decent lawyer would be able to get the suit dismissed for several reasons, not the least of which is that if the deceased had been involved in prior criminals act, and his family knew of those and did nothing, then could well be said to have aided and abetted his final criminal enterprise.

Much could be discovered during the discovery process which could then be used to bring dismissal.

If nothing else, an appeal for dismissal in that the tort is based entirely upon revenge and not valid restitution. If the perp's prior acts had benefited his family, that should be enough to dismiss in itself.
