"Self Defense in Florida: Deadly and Non-Deadly Force
Under Florida law, a person may avoid criminal liability for the use of deadly or non-deadly force where the circumstances show that he or she was legally justified in using such force. One such justification is known as “self-defense.” Self-defense may be used to defeat a criminal charge and, under Florida’s “Stand Your Ground” law, may even be used to claim immunity from prosecution.
In Florida prosecutions, self-defense **********is a type of affirmative defense********** that operates to avoid (or cancel) the legal effect of a violent act (such as a homicide or battery), which would ordinarily subject the accused to criminal liability. When an accused raises a self-defense claim, he or she effectively admits to the truth of the alleged act (i.e. that he or she committed violence against another person), but justifies the act by asserting that the act was reasonably necessary to save him- or herself from the imminent use of unlawful force by the other person. In effect, the defendant says:“Yes, I committed the violent act. But I did not commit the violent act unlawfully because, under the facts and circumstances, my acts were justifiable to prevent physical or legal harm to myself.”
The court is not restricted from ruling that a homicide is justified even if the defendant does not raise the "affirmative defense" the evidence can speak for itself. If forced to assume the burden of proof the defense has built in constitutional grounds for appeal in federal court. You need to study the law more carefully. In America one is presumed. innocent until proven guilty in a court of law. Plain and simple. Try again.......

The Constitution of the United States of America trumps all state laws. Try reading the fourth and sixth amendments. You pick one point of law and think have a case. That's understandable, it matches the one point on the top of your head created by sphincter drag. Does that really keep your asshole from slamming shut when you pull your head out?

Keep crazies and criminals locked up instead of letting liberal policies and liberal judges put them back on the streets to continue their criminal careers. That would be a good start.

On what planet are you from? Liberal teachers? You obviously have skeletons in your closet. What we're doing here is this...protecting the children at risk....NOW. I'm sorry if you were a victim of a sick individual who was in a position of authority in your life. Move ahead. We're talking about the children who are now at risk. These children face much more than abuse from teachers. That should be a given. What they face now is total slaughter from a sick individual who has their death on their number one list of 'things to do today'. We need to make sure our schools are prepared. Drill. Drill. Drill. As for your remarks? Get therapy. It'll do you good.

That responsibility belongs with the 'elected judges'. When you're afforded the luxury of voting the next election...take that into consideration. What is this candidate's view on pedophiles? Repeat offenders? Probation? Law enforcement beat their heads against a wall....why? Because they uphold the law to be met with liberal judges. These liberal judges let them GO...pedophiles included. Their excuse? Who do we release in exchange for the new charge? WHAT? When did this become the precident for incarceration? Who do we release to make room for another offender? What? Excuse me? This is complete truth. Check it out....criminals are being released back into our community because of the lack of 'storage' space. Felons, period. Who we look to first when it comes to hysterical crime? Who would harm a child with no conscience? A career criminal, a repeat offender. How do we protect our children? We act responsibly....we do our homework....we work with all law enforcement agencies....we make sure they do their job. We make sure they know who the 'risks' are...Period. Let's get real. Let's do something. Blog away...where does that get you? Top 10 bloggers? Congrats.....show me the 'money'.

Nope..........you are WRONG.....this county is the leader is pedophile residents. Why? Because we are a reservation border. Why you say, aren't they required to 'register' on the reservation? Well, sort of.....but, the reservation is sovereign...so....Because they can ignore Federal law....they do. They are not under the same USA federation as the rest of us. They are required, by law, to register sex offenders. They don't. They let their certifications lapse, they don't have any idea where or who or when they are supposed to be monitoring sex offeners because they let their training lapse. How do they provide this information to the public? They don't. Pathetic. Why does San Juan County have the second highest population of pedophiles in the state? Second only to Bernalillo County, per capita? Do the math. Diddle a child? Move to SJC. Rez side....it'll all be fine...pathetic. But reality.
