Iam one of the people in the guidant lawsuit.What can I say.We were screwed by our lawyers and the court system who was sworn to protect us. The only people getting any money out of this is the lawyers on both sides.Our lawyers had them right where they wanted them,with a chance even for punitive damages.But why take a small change of a jury not seeing it our way,when you can get millions for doing nothing.No long trials,just instant money.It was never about the money with most people.I wanted this to go to trial,no settlement,so that Guidant would have to come clean and be convicted.I will not sign off on this settlement even if I do not get a dime.Guidant had set aside 732 million dollars for the payoff,but our crooked lawyers settled for 195 million.This will not even pay our medical bills.Like they say,Doctors and lawyers will the first people in hell.

Guidant is far from out of the woods Robert. There could be a substantial number of plaintiffs feeling the same indignity who will reject the forthcoming offer from the Minnesota court and have their case returned to state court for litigation. Whether there are any attorneys similarly motivated by a deep sense of outrage and injustice is yet to be seen. Iím looking for one for a California case involving a death once it is returned from Minneapolis.

It is unlikely Guidant will get to keep the remaining accrued millions as it is yet to confront other civil plaintiffs is a number of foreign countries for defects and recalls, as well as face any resulting actions of investigations by attorneys general on behalf of at least 34 states, and federal prosecutors from the FDAís Office of Criminal Investigations, and others.

Though there is no adequate settlement for the personal tragedies and losses by patients, there possibly can be some reparation in witnessing the self-inflicted devastation brought on by dishonorable members at the helm of Guidant. That unfettered greed has cost millions in loss sales and future momentum for the pacemaker and icd medical device field, and caused the rethinking of oversight by not only medical professionals but federal policy makers and clients such as Medicare.

Guidantís day is court, their true Achilles heel, still could be coming. As they say, itís not over until itís over.

I NEVER GOT ANY INFORMATION FROM ANYBODY TO LET ME KNOW THAT IT WAS RECALLED!" Throughout my visits to the hospitals each medical professional, thought I was just anxious and over sensitive. They put their trust in Guidant instead of taking care of my symptoms. I was prescribed morphin and percoset for the pain and anti-depressent to calm me for the "anxiety" ALL of which could have been avoided if a timely recall was issued instead I experienced tremendous humiliation and frustration that my symptoms were "ALL IN MY HEAD" I have no choice but to trust Guidant with my Life! Do to the fact I cannot survive without a pacemaker! It is tremendously overwhelming to have experienced near death do to the faulty device. I feel I have been let down by Guidant Corporation that I have trusted with my life!
Still to this day, I suffer a great deal such as ......Trusting this company with their make of pacemakers that i use now or in the future if it would be recalled as well! Many scars on my body that remind me of such tragedy. When replaced the old for the new they could not take out the wires leaving them capped off and left in. Opening my chest on the other side of my body placing new wires and pacemaker. I feel as if I have no way of knowing what lies ahead as of leaving so many capped off wires in my body! To my understanding you can only fill a hole with so much that you can't fill it anymore, as like a glass of water until it flows over. The pacemaker that has been recalled and removed was to last 10 years! It was only in me for 1 1/2 years and should of been out of me before that. But no one would believe me until the last minute.
Here is an example of my pain and suffering. As you are all aware about the bridge in Minneapolis coming down, 1st my heart and prayers goes out to all the families that have suffered, 2nd as you all are aware Bridge inspectors say that the bridge was UNSAFE but the people in MN where not aware!!! Until tragedy struck without warning.
Just as Guidant Corporation knew of thousands upon thousands of pacemakers and defibrillators having major malfunctioning defaults that cause serious injury and sad to say Death! As well as the patients that had such devices going through life believing the devices was performing to their expectations until people experiencing problems being unaware of any recalls, until the last minute.
Through my research Guidant is a 27.8 Billion dollar industry. I believe they didn't inform patients due to the pacemaker stocks. As I read online through my research.
To me the heart is "priceless" can't be bought with any price. And it is insulting from a well known company that is worth 27.8 Billion to settle in court for $195 Million dollars.
We the people with the pacemakers have suffered while Guidant made Billions through our tragedy as well as life saving.
I Jody D. McMillan Is a 30 year old male and has a pacemaker since the age of 17 years old due to a congenital birth defect, I put my trust in having this pacemaker put in from my Dr. to give me longer life. I feel I have been let down!

I Lost my Dad to this also we were told he was the 3rd his shorted out and they set him up for surgery
to replace it we were told the new one was the Cadillac of models they put it in It did not last a week and it to shorted out he went from walking and talking to a paraplegic and then we lost him
One month after he passed they recalled them
If they had sent the letter when they should have he would still be here today and they would not of put
2 recalled devices in him
We have been in the lawsuit from the beginning
I was Told the 7 that passed come first and the ones still alive will follow

I am one of the plaintiff's suing Guidant. Is there any chance that there will be a cash settlement for the plaintiff., or is this a rip off by the lawyers , Hersh and Hersh. This a serious situation, and I have heard about class action suits with low settlements. Could anyone inform me of examples of what this lawsuit means to the plaintiffs if any.

Our lawyers have screwed us and think they can get away with it.well,I will not accept any offer they give to me and will take it back to state court.I trusted Seeger Weiss and what did it get us.Nothing.After they settled they knew that everyone with an icd would jump in,as is their right.But the settlement should have gone up with the numbers.All lawyers should rot in hell for what they did to people they were sworn to protect.

I too lost my father the guident difibulator they checked it on Thursday and he died Friday. I too was under the impression that 1st no settlement amounts had been decided. If some one has heard something I would like to know.. I am under the impression that my father was the 6th confirmed of 9 that had passed from this device. I am also under the impression that guident was aware of the malfunctions and chose not to report the problems to the FDA until a board members family member had a problem with it. I have been told that a federal investigation and criminal charges are imminentÖÖ. Please report of any differences

I too am part of the Canadian class action law suit and totally confused. My lawyer is telling me nothing and the news keeps appearing on the net that things are happening. If anyone is interested I had the recalled unit explanted and a new one implanted 39 months ago. On Oct. 18th I had to have the new unit explanted once again due to the failure of the capacitor. Do any of these units work longer than 3 and a half years? Does Guidant have a handle on this? I changed suppliers as I have lost all trust in Guidant units.

I am in Minneapolis and am a part of this litigation. My attorney's are trying to up the original amount as 195,000,000.00 was originally for 4000 claimants. Now that number is over 7600. That's an equivalent of very little per person. I know the court date is January 11th. Got a letter today saying they're still negotiating...who knows?

They increased settlement by 40 mil, but it appears that will cover twice as many claims. Doesn't make sense to me.
