While Judge Sturtevants ruling was legally correct under the law, Ms Middleton is partly to blame for the damage done to Mr Bakers home. Had she not fed the cats they surely would have went elsewhere. While feral cats are not suitable for adoption, Ms Middleton could have reported the cats to the Animal Control authorities. In Ms Middletons defense, she did make Mr Bakers roomate aware of the situation. Whether the roomate passed this information on to Mr baker is not mentioned, but in any case an occupant of the property did have knowledge of the situation and should have acted accordingly.

i totally agree with the person who made the comment about sealing up the house. if this was called to his attention in may of 05, he should have routed the cats out and sealed up the house at that point. his negligence in doing so does not make the insuing damage his neighbors responsibility.

They are not stray cats they are feral (wild) cats.

Possibly, if she had not fed them they would have found another place to live that would not have damaged her neighbor's crawl space. Granted, Jason could have had them removed but then the neighbor might have complained that he was mistreating the cats by taking them out from under his home. Too many issues to look at. No one is a jerk for not wanting stray animals to damage their home.

Well I'm glad Mrs Middleton is not held responsible, how ever I do believe that both neighbors needed to come up with a solution on their own instead of trying to blame the situation on cats being fed and I hate to break it to the if she had'nt fed the cats crowd, but those cats would've ventured in to the crawl space regardless of wheather or not some one fed them be cause the crawl space provided shelter and also food in the form of mice. Feral cats are every where. It's just easier for people to pretend they don't exist and then blame their being around on some one who feeds them.As for the rest of the people who came on here with their cat hating comments , grow up people!!!!!!!!!!

Please tell me that Baker has something else to do with his time then waste the Court's time with a frivolous lawsuit like this! Seal up your crawl space and you wouldn't have the problem to begin with Punter! I'm glad the flight attendant won!!

Unbelievable is correct in this case. I wouldn't make them suffer, a live trap could be attempted and if that did not end up working a high performance .22 cal pellet rifle would ensure a quick painless death.
