Chipotle Mexican Grill Gets Beaned

A California lawyer has taken Chipotle Mexican Grill restaurants to task because he ordered and ate their pinto beans after being reassured by their employees that they did not contain any meat. As it turns out, Chipotle’s pinto beans include bacon. The lawyer, Kevin Shenkman, is seeking class action status on behalf of consumers with dietary concerns who bought the beans. Shenkman is both a vegetarian and Jewish and does not consume any pork products.
Shenkman is claiming negligent and intentional misrepresentation, fraud and violation of California laws barring false advertising and unfair business practices. Chipotle has responded that their pinto beans have always been made with pork and have never described them as being vegetarian. Chipotle serves a vegetarian alternative to their pinto beans – black beans.
Chipotle carries this warning on their website,“You should avoid our pinto beans (they are cooked with a small amount of bacon) and meats (obviously).” I don’t know if this was posted before the lawsuit or after it was filed, but the company is addressing the issue.
What are your thoughts on this lawsuit?
