There are 40 comments on the Columbus Dispatch story from Jul 19, 2011, titled Wendy's sued for its use of slogan | The Columbus Dispatch. In it, Columbus Dispatch reports that:

Wendy's latest marketing campaign, which uses "You can't fake fresh" in some of its ads, has prompted a Florida-based restaurant chain to sue, saying the slogan is its trademarked tagline.

I don't know about anyone else, but I would never mistake some nasty fast-food burger joint for a Florida seafood restaurant.

Another frivolous lawsuit just so attorneys can male big bucks. I don't remember Webdys selling fish . If they did, then the slogan will have merit for a lawsuit. Also the Wenfys chain can just buy up the minnow chain and add fish to its menu.

Just another frivolous lawsuit to make greedy lawyers more wealthy. Besides, the Florida restaurant sells seafood and Wendy's sell beef. It's like comparing apples to bananas. Stupidity reigns! But, it's Florida - what can one expect.

Wendy's is the worst advertizing company that I can think of. "You know when it's real" ?? what the heck is that supposed to mean? "You can't fake fresh..." does that imply that you are 'faking' things not related to freshness?? Mr. Wendy was is a complete tool and loser. RIP DAVE.

Wendy's has the best fast food burger (NO shredded lettuce)of the top three chains. Wendys should offer an egg sandwich with a muffin, egg,cheese,canadian bacon. NO biscuit.

I wonder if the company bothered to call, write or contact Wendys in any way about this before they filed a law suit. I also wonder why Wendys attorneys did not research that phrase before they started using it.

This lawsuit is a pathetic money grab. Wendy's uses this slogan around the country where nobody know's about Pincher's. Bottom line, Pincher's is rarely fresh, and normally of poor quality. All I see in this is an act of desperation from an owner whose legal tendencies mirror the moniker of it's name sake, a bottom feeder. Owner of Pincher's, the following message is for you: You are what's wrong with America.

Wendys hires an advertisement company to do its' commercials . Since they approved of the slogan, then they are responsible for it. I am sure their attorneys have already researched this issue and found the slogan ok. I would love to see Wendys come out with a nutritional fish sandwich that isn't deep fried. This lawsuit has no merit. Just some lawyers trying to get richer.
