Buckhannon smoking ban effective today; smokers upset

Buckhannon Mayor Kenneth Davidson said he would request that city police officers not enforce the recently passed smoking ban during the West Virginia Strawberry Festival after four citizens aired their belated grievances Thursday regarding the ban that takes effect today.

it brings some money to local businesses, hotels and things like that. But I do wish the mayor would grow a pair of balls. If the ordinance is passed, then he needs to enforce it,regardless of who is pisses off.

I am not a smoker but the mayor did grow some balls ,he admitted what a stupid and ignorant ordinance this is,why should a half a dozen people sitting behind a table be able to take away a personal right without some kind of resident majority vote. also for you people that don't know 3 of these council members sit at the Moose and Elks smoking every day.

Its still the law. A sitting Mayor can tell the Police to stand down and NOT enforce the law, just because they want Strawberry Festival to turn a profit?

Im a non smoker but the way I see smokers pays taxes just as much as the non smokers so why should they give up their rights to smoke bc you don't want to be around it. If its that big of a problem to you stay home no one asked you to go. And if you don't want to be around it or want your kids around it move to where there isn't anyone smoking. I understand at the carnival maybe no smoking but on main street they should be aloud to smoke all they want bc as I said before they pay taxes to and technically its a state road even if its in city limits so I don't see how the city can make that decision in the first place.

You have the right to purchase liquor, be medicated for pain through prescription pain pills, and obtain a gun permit and carry a concealed weapon- BUT- you can't get liquored up or get high on your pills and get behind the wheel of a car- You don't have a RIGHT to do that.

You can't take your guns to school, or to court or to a host of other places where the concealed weapon permit is trumped by the interests and rights of others. Everyone has the right to breathe clean air. And the tax argument is about as dumb as it comes. Perverts pay taxes, too, but it doesn't legitimize their hideous, criminal actions.

And while some here seem to think that what Buckhannon has done is earth shattering- there are hundreds of cities, big and small all around the whole big country who've enacted bans as expansive or even more so than what's been done here. Try smoking in PNC Park, Heinz Field, Mountaineer Field, public parking lots in many locations, or even on the street or sidewalks. These bans are coming, they're coming to a bunker near you-

Sunnybucker....I have no idea why you beleive that taking someone's rights away is a good idea...you speak like you are somewhat intelligent, but just don't seem to get it. OK....say I'm allergic to dogs...they bother me, I'm highly allergic. So, I do not go into houses where dogs live inside. Should I go to the city and try to pass a law that dogs can't be allowed anywere outside in public? OOhhh...I can smell them...it bothers me...my grandpa was killed by a dog, I'm scared of them...REALLY...WOULD the dog (on a leash of coarse) really bother me so much outside? NO!! Because it is not concentrated dog dander/smell...like it was indoors...right? Are you with me? And why selfishlly take away the rights of so many? Yes smoking is a right...and our rights are dwindling within this day and age....it creates tension, rage, hate, stress...the list goes on....why can't we just live and let live? Way to go Kenny...city council pulled a completely irrisponsible and incredibly STUPID move and that crap needs ammended...completely take out the part about the festival....Remove completely any reference to e-cigs AND make designated smoking areas at the parks....PROBLEM SOLVED!!! Everybody happy....Crimany....maybe every city council member needs removed and replaced with logical thinking people with their heads up and not down under :-0

I agree completely!!! In fact I believe it's time for all of upshur county to have a say in what happens in our city, not just the people living within city limits. Even business owners that have a business in city limits don't have a vote even though they pay the taxes. I believe it's time to abolish the city government all together and create an upshur county public works. Let the upshur county commission handle things and that way we would all have a vote in city matters. The police could become a part of the sheriffs dept. but be assigned to the city limits for their patrol areas, but if needed in the county, they could go also. The city water and sewage and so on could all be part of the upshur county public works as well as the adrian psd, and mt.hope psd and so on. It would be so much simpler and with less corruption.As for ignorant bans...we should all have a vote on matters like this...after all, the majority is supposed to rule. I just think it's sad that people are so ignorant to want to have so much control over the actions of anyone that doesn't think or do as they do. People are so greedy.....next it'll be big macs on the hit list!!!!

Why is the tax argument dumb? Smoking is not a crime like perverts as you called them. It is your right to breath clean air so if you don't want to be around it then don't go or move away from someone smoking its their right to smoke as well as it is your right not to. How is it fair to take one persons right away from them just to give someone else a right. I think the best way to solve this solution is to make one side of the street for smokers and the other side for non smokers that way you don't have to breath it. and that is pushing it. And for ppl worring about their children seeing it. they see it on tv everyday. Just because they see someone smoking doesn't mean they are going to smoke. I live in a house full of smokers but I don't smoke it and I don't like it but that don't mean Im going to try to take their rights away.
