As the Supreme Court prepares to hear Hollingsworth v. Perry and United States v. Windsor, opponents of same-sex marriage have scrambled to answer the central question: What is the government’s rational interest in preventing gays from marrying? The standard argument from moral disapproval was revoked by Romer v. Evans and Lawrence v. Texas. The argument that gay marriages undermine the family has been debunked by a decade of same-sex marriage in several countries. So, as Proposition 8 and DOMA wound their way through the courts, gay marriage opponents lit upon a more durable argument, seemingly grounded in science rather than animus or religion. Their case, presented most comprehensively by Princeton professor Robert P. George, is that only sex acts with a “dynamism toward reproduction” — that is, penile to vaginal intercourse — create true marriages and lead to legitimate child-rearing. Same-sex marriages, by this theory, are not “real” marriages, because they do not involve “organic bodily union.”

Editor's note: so I guess all infertile heterosexuals are also denied legal marriage then?

If the court found that their prior precedent did not link procreation and marriage, i would say i was WRONG and accept that.

It is possible for SCOTUS to toss Section 3 of DOMA and rule that the proponents of Prop 8 don't have standing.....thus overturning the 9th's ruling and leaving Walker's ruling intact!!!

I guess we'll have to wait and see how it goes......but one thing is for sure......I don't recall you being given anytime to present your argument.....wonder why?

All they have to do is prove that there is a state interest in doing so. So far, no one has come up with a valid one.

And, regardless of how the SC rules, the fight won't stop until gay folks can marry in every state. It's just a matter of how many tax dollars those states are willing to spend in the fight.

I know the difference between these 2 words, and similar words, and with all due respect, I find myself making the same mistake online, not because I don't kow teh difference, but sometimes one types on the keybaord faster than one should.

I frequently type (but not write) the word "the" as "teh", not because I am stupid, but because for some unknown reason, my fingers insiste on depressing teh keys in that order. I have spent so much time correcting that word here, that I have given up doing so.

So I suggets you cut some people here some slack, as I believe it is often a matter of keyboarding skills, rather than intelligence or anything else.

Regardless of what happens with Prop 8......my legal marriage will STILL be legal, valid and recognized by the State of California and any other state that legally recognizes marriage performed in another State.........however, come June......my marriage could have federal recognition as well!!!

If marriage requires the married couple to be raising kids, then I guess my same-sex partner and I would be safe. After all, we are like many same-sex couples and are raising kids.

And I guess all those childless heterosexual couples will just have to rip up their marriage certificates since those are invalid, right?
