It's probably too big a liability risk for the town. Not to mention if there are any neighbors, you've got to consider their right to not have to listen to those things farting along all day every day.

The town does NOT own conservation land; the Conservation Commission does. ConsComms were established by state law to protect open space and wetlands. They are responsible to be good public stewards of the land, but they have exactly the same rights as any private landowner. Open space, by law, defines the land use to be PASSIVE - that means anything except motor vehicles. ATV's on conservation land are illegal, period. If you don't have the private land to ride an ATV on, don't buy it. Would you buy a boat and then expect taxpayers to dig you a lake?

Ahh, the land is granted to the Town or procured by authorization of the Town at Town Meeting. The CC is an authority, below is an example conservation restriction lead in:
acting pursuant to Sections 31, 32, and 33 of Chapter 184 of the Massachusetts General Laws, hereby grant to XXX [or, if to a municipality,“the Town of __________ acting by and through its Conservation Commission, by authority of Chapter 40 Section 8C],

Why not blame global warming on ATV'ers? It's not right to be riding on conservation land (by law). This land belongs to all tax payers, not just horse back riders. Remove this land from Conservation status. Then it's no longer against the law. Many of us in Lunenburg would rather see houses in these areas. If we can't use this land, give me a property tax refund every year.

Or sell it this land to the Audobon folks. Their pockets are much deeper than taxpayers in town
