First off read the article. The prosecutors dropped the case but the judge still has yet to rule on it. We shall see if it will go forward.
Why Spain? Two reasons. Spanish law, like US law, recognizes universal jurisdiction for crimes of torure, meaning that tortureres can be prosecuted anywhere, regardless of where they committed their crime. Also some of those held at Gitmo were Spanish citizens.
Baltasar Garzon, the judge in this case also indicted former Chilean Pres. Pinochet in 1998 for, among other crimes, the torture of Chileans while he was in power. That started criminal proceedings in Chile.
The main reason I think they started this was to encourage the US to launch its own investigation and like Chile, not rely on Spain to call the shots.
Spain is not the only country conducting a criminal investigation. On March 26 Britain's attorney general, Patricia Scotland announces she was launching a criminal investigation into allegations that British officials were complicit in the torure of a British resident captured by US officials in Pakistan and rendered to Morocco before being taken to Gitmo.

I have lived in Spain for over 20 years now. The poster that indicated Spain should clean up its own back yard first is RIGHT ON TARGET! Garzon is nothing more than a political hack that does the bidding of Zapatero and spends most of his time trying to drum up cases of corruption agaist the opposition party. When an ETA criminal that murdered 22 people is released from jail after serving only 18 years in prison, there is something wrong with the system. Then, if you shoot and injure or kill an intruder into your home, YOU are the one that is prosecuted, not the intruder. Criminals are given sentences over 100 years in prison, while the law states that law breakers can be incarcerated no longer than 30 years. Typically, they serve around 10-15 years AT MOST, including murderers. The system needs to be overhauled from top to bottom. And, by the way, Bush SHOULD be prosecuted, but under the American system or in the Hague, not Mr. Garzon's pseudo system.
