is anyone else pissed off that the "very" special masters in the zyprexa settlement are getting 7 million plus the interest from 690 million as payment for the "very" hard work that they are doing on this case?
if i'm wrong about this please set me straight, but that seems to be what i read in the mailings from my attorney. |

If you don't already know about this, I read an article at IndyStar.com regarding the settlement. According to Nancy Hersh, a S.F. Attorney who represents hundreds of claimants, said payouts should start to be mailed around June, and that Eli Lilly made the deal contingent on at least 90 percent of the 8,000 plaintiffs accepting it.

I heard that the special masters still have to meet a certian amount of people that were injured by zyprexa. There have to be a number of approved claims. If they need more medical information, you have 30 days to get it. I am mad because I can't get one of those lawsuit loans. The $700 million claim is a private claim, the other people they added will not affect the original 8100. This thing can go on forever, if it is ever approved. By getting one of those no wil loans at least you will get something. I bet they work around the June schedule. The whole thing was supposed to over with by november 2006, but I called my lawyer, and they gave the same old bull. I am beginning to think something fishy is going on. Now I am being told that it will take a while to go through the 8100 claims.

news flash- spoke to my attorneys today, after two days of calling them, the pay out date is now august/september... maybe. and now SURPRISE, mention of "administrative' fees. i am writing to the judge to express my displeasure with having it crammed up my pooper without any grease. who would put these "special" masters in charge of the payout, when they have a vested{ millions of $} interest in dragging their feet. do you think that for 7 mil plus that they could hire a few more flunkies to go through the med records and get this thing resolved? the lawyer told me that the masters were the holdup. it seems as usual the lawyers {they don't call them sharks for nothing} are the ones who are going to make out. oh, did i mention that the "special" masters are retired judges and lawyers.

Bad news flash.
I heard that the reason for the delay is that some law firms did not send their stuff in on time. The judge got mad as he has extended the date twice, that he was going to move it up a year, but other lawyers talked him out of it. Now they are trying to go ahead and pay the B track claims, but nobody knows if the judge will do it. |

when i spoke to the lawyers, they told me the $5k "awards" were going to be paid first, leaving the larger payouts to gather much needed interest for the very "special" masters. how nice that people who weren"t injured at all are going to make out so much better than the people who were. ah...but it's the american way. i"ll try to keep my bitterness to them at a dull roar, but when i was figuring it out after the first announcement it seemed that everyone would get around $80k. now some poor bastards are getting $5k {minus attorney fees and administrative fees}. it stinks and i don't know how these sharks circling the jackpot can look at themselves in the mirror.

Those people that get $5000 are the ones that did not get diabetes. They just gained weight, etc. They just used them to get the 8100.
Dom, where did you hear June? I e-mailed one of the "Special Masters" and they said Mr. Reamed, This is in response to your email to Special Master "big money". The four Special Masters in the Zyprexa Matter have been reviewing the more tha 8,100 claims received in the Settlement. This process is ongoing and we are hopeful that compensation will begin to be paid in early August, 2006. If you have any additional questions, you should contact your attorneys. Thank you. That is a real e-mail with name changes. Maybe they are mailing out the award letters in June but paying in August? |

I live in KY and I have contacted the AG. They were not even aware something was going on. They do now. He told me he would contact the W.VA AG for more details.

Hello. I just ran across this message board after doing a search on Zyprexa litigation and attorney's fees. I was diagnosed with pancreatitis 2 months after taking Zyprexa. I must note that I have never been diagnosed with any type of mental illness. I was administered Zyprexa while being hospitalized w/ blood clots. I was told it was to help me sleep. I continued to take Zyprexa on and off for 3 months as a sleep aide until I found out what Zyprexa was used to treat. I had abdominal pain for about 2 months until I was diagnosed with pancreatitis at age 29 during an ER visit. Since my diagnosis, I have had at least 5 ER visits (to get morphine shots to control the pain) because of the pancreatitis and have flare-ups often (about 1 very 2 months). Needless to say, I have racked up bills from my ER and doctor visits even with my insurance. I was told that I could only receive $5,000.00 because I didn't meet the 60 day mark of being diagnosed since my last use of Zyprexa. It was more like 70 days :-(, although it is noted time and time again in my doctors notes that I complained of abdominal pain. As I said before, I still suffer with the pancreatitis (which can turn chronic and lead to death). To top it all off, I was told that I could probably get a settlement of $5,000 but after all fee's (attorney's 33 1/3%, special masters, and administrative fees) I would probably receive $2,025. This is crazy!!!
