Our lawyers probably knew or should have known that they would be back - this time as claims were being settled. The insurance companies came back and probably have no right to any money in the Avandia settlements but by threatening to sue, they've already slowed down the process, and can slow it down to a snail's crawl. I suspect that a few posters would want to fight it out, but an overwhelming majority want their money now. That's the leverage the insurance companies now have...OBAMA RULES!!!

Why? like what happen to Merck with Vioxx, GSK studies the lawsuit and try not to make the same mistakes that Merck did. Merck studies the lawsuit with Pfizer, and try not to make the mistake Pfizer did and so on and so on. Every medical lawsuit is difference. Just like in a murder trial, some lawyers find new evident and the other lawsuit has no clue on what happen until it happen and then react to it. Just has Rufus denied the insurance, they come back appeal and win the appeal. What infor that we know is just the tip of the iceberg.

I saw where Rufe denied the insurance companies the first time, but did not see if they appealed or if it was successful. I guess they could argue that if Medicare must be reimbursed, that they too should also get paid as well. It just seems to me that if a person has paid their premiums on time the purpose was to insure that their medical needs would be met when needed. What out attorneys are worried about is the insurance companies drawing this out. GSK is worried about having to pay more than they agreed to originally. In the end, the one's who will pay are the injured and the survivors...OBAMA RULES!!!

I forgot to mention that with Vioxx settlement that paid out almost 95% of the payment to people, the insurance are also going after Merck, many years later, for the same reason they are going after GSK.

No. paying settlement for the same reason it is paying us. When funds are paid, you'll sign a statement saying Gsk is not responsible for your medical problems. The insurance companies will do the same.
