Got good news - spoke to my attorney and was told I will get my check in about 1 week now. That is better that 2 weeks! And it is coming Fed'l Express!

Great news Concerned! The check will be here before you know it.....Now...if we can get that lien resolution money back soon we will be doing OK. I understand all will have it back by the 23rd of December.

I haven't been here in a while....guess I missed the 'fake' Dick comments.
Seems things are winding down and most are getting paid....Now we need to get our IS friends through all this.Good luck all.....I am wondering if anyone has heard from David lately?

Garretson said they are sending a small part of it the end of Nov to my Lawyer. Is there a deadline on the Government Medical Liens to be paid to us in full? Or is going to stretch over several months? Anyone know?

Congrats! our lawyer should have our check by 10a.m.tomorrow and said that once it's deposited,we should receive our money in about 8days. I'm so glad all this is finally coming to an end and we can finally pay some bills.

My husband has a MI case and his attorney is Weitz & Luxenberg in New York. We have not been able to get very much information from them (surprise). Does anyone out there have Weitz? They told us that Judge Fallon has decided that settlements can no longer be made in 2 payments. He didn't get an initial payment. Therefore, we have to wait until they calculate EVERYTHING and make sure it is absolutely correct before they can send his one and only check. Weitz does not seem to be in any hurry to get this money out? It is so frustrating!

ABE - I'm in the same boat. I have not heard anything about a partial payment in Nov. Did they give a reason for only a partial release of the lien?

Problems!! Just got back from a trip. No check in the mail. Called law group. They told me they were holding up on issuing check because Florida law says the attorneys must notify any and all insurance companies I might have had. This is not a lien in itself but a law that says they just have to notify the companies about my settlement. That is so the insurance company then can go after the money. Has nothing to do with LRP or Garretson, etc. Think it's part of the subrogation law. If I would have known this, I might have gone in on the LRP because my insurance company only paid out $1300 (most of it was Medicare). Now the attorney is checking because one of the other attorneys told me a month ago that nothing would be withheld from my check since I didn't participate in the LRP. I would have to deal with my seconddary insurance on my own. Now there is a holdup because I have to wait for them to notify the insurance company and then wait 30 days for the company to reply. GEE!! What do you think their letter is going to say? Oh, he owes us money? Tell us more. Where do we find this guy?

I really believe they are just paying you back for not signing the lien resolution because the attorneys don't make any money if you don't sign and it makes them angry so they take their time. I don't believe we signed anything that says they can contact our insurance. I do know we are supposed to if there is a subrogation clause in our insurance handbook. But check to see if you are in a subrogation state (where you have to subrogate with your insurance company .) If you are in a non subrogation state I don't believe you have to pay your insurance company anything.

No Mary - All the law firms have to condsider liens. That is why I signed up for the LRP back in June. Just 15% was withheld from my check and most of it will come back to me. Maybe by the end of November all of it will be released. It only costs $150 dollars to sign up and my law firm can clear my claim because they know Garretson is taking care of the liens.
I am still waiting for the final check payment but then in one month will probably get the rest from the 15% held back. Just in time for Christmas!
