At the 4 points, you will only get the base line. THey cant cut you any lower. THey first told me I only had 2 or 3 points. I appealed, sent in my reasons, and I got my points up to just over 100. A 98 point icrease. It was well worth the extra 2 weeks or so for the appeal to be looked at. Best of luck to you and keep up the good fight!

He is was trying to obtain the 40% the Judge said he could not have, and thinks he found a way around it by labeling it SHARED COSTS. Will someone please PLEASE give me the number to the Judge and tell me what to do. I am so shocked when I read that you said 1700. was to much I almost fell thru the floor. I have not signed my statement yet and I have waited 8 years so a little longer will not hurt to make sure this CROOK of a lawyer does not get what is RIGHTFULLY MINE. HELP..... (Excuse the typing I am so MAD) Hey Alaska, Feel your pain. My attorney charged me around $200 for personal case costs. Expenses for the entire vioxx clients represented by them totaled $18,000 divided by total vioxx claimants(225)=$80.00 for my pro rata share. Sounds like you're getting ripped off. Appeal this crook's actions to Fallon.

You can also call jenn at Brown Greer and get answers. I would think the shared costs would come to them thru the 8% fee fund being collected by BG from the lawyers 32%(lawyers got 24% and MDL shared costs were 8%= 32%) You have to ask your lawyers for the explanation and Brown greer!

I was told it is for the amount of expenses the common benefit didn't cover. Each plaintiff had to share this cost.

Good luck, and it doesn't hurt to let this attorney know that you will be calling Judge Fallon and the State Bar...

I swear I am not a stupid person but I am having a hard time understanding what other expense any of these attorneys could have other than for Fedex ,ups, postal fee, copying fees ,ect.Thats it,as for expert witnesses, cardiologist, ect, the re weren't any as none of us went to court.it was an agreement prior to any court hearings. The common benefit fees we all paid were to be shared by those attorneys that actually did anything other than push papers whick the bulk of ours only did, push papers. There is no way any one of us should get thousands of dollars deducted for such b/s.Copy your recaps where they want that much and fax them to judge Fallon .Stand up to these crooks!

I called his office and left a message so someone can call me back. This expense includes paying for cases that were taken to court. As far as I can remember most of the court cases were lost. I thought if a case was lost there would be no fees or expenses that would have to be paid. At least that is what my contract read.

Dick, you're absolutely right! I should have clarified the "expert witness" charges...in the very beginning, before all the paperwork went to B & G, my firm had an expert cardioligist review every case to look for discrepancies in any medical records....I assumed that is what the charge was for...I don't think my firm had an abundance of cases, so that fee would have been split...I ended up with 66% of my total award
