Conerned,I would think you are past the statues of limitations regardless of what the Insurance company would want to pursue,state laws or Erisa.Looks like clear sailing for you regarding any liens.If you should get one later fight them using both,especially ERISA as they tried using those guidelines to get at us when they originally filed on us before Judge Fallon.If you need the court records let me know as thier motions specifically sites & quotes ERISA.Use it against them as they can't have it both ways.Best wishes on hearing any news.My recap has set at attorneys offcie since 10/30 and no word yet.I have a little surprise for them as for after the first of the year I will check with the state and make sure they paid the interest to the leagal aid programs as required.I am not let them slide on anything.I also told them before they sent out the recaps to make sure the difference I paid them on the IP payments regarding thier fees as included,surprise it was ,petty but after how they have treated us I figured 400 bucks was better in my pocket than thiers.

Was away all weekend...got my check on Sat....no liens....off to the bank on Monday.... Hope everyone will get their check this week....I did not sign the Lien Resoulutin program..If the insurance company wants to come after me...then we will meet in court...It was all a fishing game!

There is no one you can turn to, including President Obama when it comes to pharma's. No politician would have been helpful, as possibly all have their pockets lined with pharma dollars (now some of our dollars). It would have been interesting to find out how a politician(also, lawyers, doctors, judges, top wealthy, lobbyists, etc.) faired in this vioxx settlement with their own cases. You can bet more than 100 points were given no matter what the circumstance...stroke, MI, death, how much paperwork presented, consitency, medical background, insurance liens and more. Just venting, but it feels good whether right or wrong but a good point to ponder. Haven't received final check yet and was told not until after the 15th.

Hey, does anyone find it odd that a number of us have received a phone call from FedEx telling us we will have a delivery today? My first payment came via the post office, certified mail, and, I have never gotten a "heads up" call from FedEx before. Could someone have shaken these attorneys up, and given them a deadline to get checks to us?

Obama administration was not in office when we were injured by Merck and vioxx. The administration came in after we had filed our lawsuits.

Jerome...no, I have NEVER gotten a precall from FedEx..I prefer using UPS, but have received alot from FedEx, and that phone call is a first for me. That's why I'm wondering if someone has given the attorney's a deadline for getting our checks to us.

Mary...as I said, I'm not making a political statement..just saying that maybe something should have been said about the people who had been actually had been killed or hurt by this drug! Whoa ,congrats on getting your check.I also agree with your statement.The American public doesn't even realize that far more people died at the hands of Merck and thier Vioxx than died at 9/11.The estimates of 3100 people are far,far too low as upwards of 60 thousand died from Vioxx as estimated by non partisan physcians & scientist.Only 3100 were fortunate enough to have passed the gates with than 5% of the deaths having ever filed against Merck in the first place.Let's hope & trust God has special punishment planned of them later.

There is "NO WAY" Fed Ex called - They deliver mail - they do not know what is in it. SW has their lawyers call us the day before a recap or a check goes out- for our benefit.

Also my opinion on President Obama- He did the right thing. He backed the innocent investors who lost money on a company that had inside info about a risky medicine and had not told the investors about the risks.

On a up note - got thru to Garretson today. And they are releasing almost all of the lien money withheld. They are still holding a portion and checking out claims agasinst me. I have not even heard of the comp claiming a lien against me.

4 companies filed liens against me - 3 were reduced to Zero! And the last one they are still working on. Again I only had 1 company at the time - and one new company now. But it goes by name, DOB and SSN. If none of the expenses were MI related they get dismissed.

Concerned: I agree that FedEx would not know what is in their delivery, but I know for a fact they did call me, cause I had to call them back, and they said that a package from my law firm would be delivered today...but, the Fedex customer service rep did say something very odd....he said, "the package hasn't been picked up yet", and this was at 6:00 pm Friday!

Just got through to the Garretston Firm and talked to Kim she said I had two small liens and that they had been released to the lawyers portal. I see no reason for holding checks.I sent an email to my lawyer if no answer I will be on the phone to Judge Fallon.
