Judges don't make the law. If they do, they're deemed "liberal activist judges." The "article" you cited (and incidentally, examiner.com is not an authoritative or reputable site, but a pay-for-content site based on user submissions, much like associatedcontent.com ) lays out the basics of the regulatory scheme at issue. Judge Stacey applied the law as set forth in the article you cite, and he was obligated to do so. Had he done anything else, he would have been an activist judge and a "tool."
