Hopefully, the man invoked his right to remain silent untill he had legal counsel...most likely he thought that he was being burglarized or robbed and fended off what he thought was a criminal attack. People do have a right to self defense and it's easy to see that a jury would understand this should this case go to trial. I know that if I was on a jury, I'd totally understand the homeowner who was broken into in the middle of the night, shooting at what he thought was burglars.
