Doesn't that mean he was either on drugs or alcohol to be charged with murder rather than manslaughter or vehicular homicide????

@Country Boy, not at all would I have thought he was guilty. I would feel sorry for him that my loved one pulled out in front of him, caused this tragic accident, and now his life is turned upside down through no fault of his own. However, I suspect that the Commonwealth is not going to waste time and taxpayer dollars and try to convict a "speeder" of murder, which is ludicrous at best. If drugs or alcohol were involved, then so be it, carry on Commonwealth and good luck to you. But it sounds like they are starting their charges high, looking for a plea deal to something like involuntary manslaughter and set a precedent for us all, that as drivers and neighbors, we need to realize speeding can be as deadly as driving impaired.

So far, I have found nothing online about any toxicology screen proving one way or the other if he had any illegal substances in his system the day of this accident. If someone has a link to say otherwise, would you please post it?

If not, I guess we won't know for sure until the prosecuting attorneys place all their cards on the table.

Sad situation all the way around. Very sad to loose the life of a loved one suddenly like that.
Been there, experienced it first hand.'Anger' doesn't even begin to describe the feeling you experience......

I saw it and it was her fault she pulled out in front of him!! He wasn't drinking and it was an accident!! If you saw it you would know that!! This town is eager to place blame and voice their ignorant opinions so quickly because he was the assistant county attorney!! If he were just an average guy with an average job I would bet anything people wouldn't be so quick to judge! Yes it was a horrible accident and a life was list because of it but like I said I saw it all and it absolutely was not his fault!!

if you saw it you are a witness and you should provide testimony during the trial. you don't need to be talking about this on this site. tell it to the jury.

I know him an yes everything that means anything to him has been lost or taken away from him he has already went through hell and high water, If anyone really did see what happened they should stand up for him and testify in his defence. He is a good man and he sure never walked out the door and wanted to go kill or hurt someone, it was an accident. but it took his life too as least the life he knew, he has lost everything over this,an accident, It could be any of us in this position.

With NO BLOOD EVIDENCE you know the outcome of this trial. Lawyers

Anyone outside the little ole boy's club would have been "tarred & feathered".....driving 70 mph from downtown traffic light should
speak volumes. And for the judge to suppress blood evidence is beyond the pale & should be investigated.
