Calif. teen to be retried in gay classmate killing

It's DEFINITELY hate crime. I think the inabilty of teh jury to reach a verdict smacks of homophobia.

This guy should NEVER be released from prison.

I just read of a teenager in Virginia who was convicted of committing several robberies. He didn't kill anybody and you know what his sentence was ? NINETY-SEVEN (97) YEARS ! He'll never see the outside of a prison again in his lifetime.

And this innocent child is murdered in school, in an obviusly premeditated plan, and the jurors can't agree on the degree of guilt ?!

I also just read of a case yesterday where in 1944, a 14 year old boy (whose guilt is questionable) was executed in the electric chair. Did you know that the U.S. executed 14 year olds in the 20th century ?!(I didn't !)

Your assumption is probably dead on...as someone whom was picked on in middle school,and early HS yrs - I can pretty much guess what happened....Larry got tired of the constant ridicule,gestures etc..so instead of retreating,and coiling into a ball of depression...He wore thier scorn with a badge of honor, they called him Fag,queer whatever and most likely - he smiled and blew kisses at them....what else was he to do?(retreat/coil into that ball of depression, Noooo)..I say - Good For Larry, tho he had no idea he was dealing with a mental case as McIlerney...Hence larry being murdered...

I agree, although I don't think the accused is a mental case. He's just a hate-filled murderer who should spend the rest of his life in a very small prison cell.

This crime was clerly premditated so it's first degree murder, regardless of age (at least morally). So what would you sentence him to ?

I agree about the charge of pre-meditated murder. I am careful and reserved regarding degree of culpability in sentencing. I would need to know far more about him than has come out during the trial of fact. Since the sentencing phase has not yet occurred due to the hung jury in the last trial, the information I need hasn't been presented yet.

I remain angered and horrified, and furious at those who taught him and influenced him towards this act. Because of this, I am not a righteous judge.

He gave you a very reasoned answer. Looking for simple answers to complex situations is fruitless. It is better to wait and get all the information before convicting and condomming this boy. No wonder you support the Tea Party and right-leaning politicians who would work to end what few rights you have as a (supposed) gay man.
