I read several comments when this case was initially going to be resolved that this sentence was rather light. I would have to agree because it would have been in reality only 2/3 of the ten years (6.6 years)or perhaps 80 % of 10 years. That would be two years for each life extinguished that night. Perhaps if this was his first DUI, or if he actually was a licensed driver, he might get this sort of extreme leniency. He is a habitual drunk driver who knowing and willing made the decision to drive intoxicated (alcohol/drugs) while his license was suspended or revoked for the same offense. Taking a more in depth look into this matter will bring a more appropriate closure to this case. I do want to add, and I hope this is not contradictory to my implied position, that all four "victims" in this crime made a choice to enter the vehicle. The question is were they knowledgeable or not about his driving record and his license status. If he hit and killed four people in a different vehicle, I am sure that the prosecutors working this case would not have shown any mercy on him, they did show mercy due to this issue. None the less, this judge, and myself, believe that the extra light sentence was sending the wrong message to the people and the slain youths families.

Shhhhhhhh... the more blame heaped on Baker, the less blame that has to be accepted by the victim's families.

Baker? Of course he is guilty and responsible. Of murder? No way. Multiple counts of manslaughter with aggravating circumstances? Sure.

As a trinity county resident i feel the plea bargain would have been the best The fact is a lot of people drink and drive in this county.

yes he should be punished for his actions, but have some respect for those who have died in the accident and the many friends and family members who still mourn the loss. as summer approaches i hope everyone takes the memory of this and rembers to be safe.

It amazes me that such a simple case generates such hate and polarization with regards to simple facts. Six young people got into a car after having been drinking and consuming drugs on August 31 2007. Four of them have already paid the ultimate price for their crimes. A fifth Zach will forever live with the memory of Stephanie dying in his arms. The Sixth Mr. Baker is a repeat offender who apparently has no regard for his or anyone else’s life. These are the facts. The charges against him fit the crime, learn from it, I did the first time and thank God no one got hurt

I do feel very sad for the victims families in this case, but to be honost, it was not Cody's fault that the people who died got into the car with him. Weren't they all under the influence of something? Everytime you or I step into a vehicle with another driver we are taking a chance of being in an accident, I would have to take some blame in that, don't you think?

What blame can a body in a bag take? Those 4 paid the ultimate price for not making a good choice that night. Let's go back to the fact Cody is a repeat offender who takes NO responsibility! Why not plead guilty for the charges he faces - is he denying he was the driver?... another instance where Poor Cody is just a victim of circumstance! What an ignorant response!

Those kids all new what they were doing when they got in that car. They had been partying like that many weekends before drinking & driving. He just happened to be the one driving that night. The judge should take into those considerations too.

attempted negligent homicide is what EVERY person that drives while intoxicated should be charged and convicted of.

driving while intoxicated is a violent crime.

it is just not possible to believe that anyone can think that consuming any kind of drug, if that drug be beer or speed or heroine, or any of the other popular entertainment drugs, and then driving is anything other than life threatening behavior.

and as for people in the same car with the intoxicated driver, they are accomplices to the act, and therefore, in this case, should be seen as criminals that died while assisting the prime perpetrator, not as victims.

and any that survived should be jailed, charged and convicted as the criminals that they are.

how can people that sit at home and eat a pot brownie and laugh at a blank wall be considered more worthy of jail time than someone that drives while drunk and can only defend themselves by saying "i was drunk and didn't know what i was doing".
those 2 acts are not equal.
then you fill the jail with giggling brownie eaters, and let the dangerous people out because the jails are overcrowded.

I think this guy should get the book thrown at him. The judge was right to toss the plea deal. A DUI offender with a suspended license and driving drunk again. What an inconsiderate SOB.

After surviving a drunk driver crashing into me, I have no respect for them. When anyone gets behind the wheel of a car, they take on a tremendous responsiblilty to everyone inside of the car and outside sober or not. Everyone has to be responsible for their actions.

Murder: The unlawful taking of another's life.

Driving drunk, killed four, ie; took their life unlawfully.

Guilty of vehicular manslaughter YES!!! Guilty of murder NO!!! Those who died that night where as guilty as the driver. You can't tell me they didn't know that they should never get into a vehicle with a drunk and or drugged driver. And all six piling into a small honda??? A sober driver also offered all of them a ride that night and guess what they all chose their fate by climbing in to Cody's car!!! Sorry, but the truth sometimes hurts. The families of these kids really need to look into their souls and they will realize that their son's and daughters were responsible for the choice that they made that night. This is NOT a murder case! Throwing the book at Cody for the choice your kids made will not bring them back to you. WAKE UP!!! I hope I'm on the jury for this one..
